The contracting authority should accept the European Single Procurement Document (ESPD) as defined in Directive 2014/24/EU for exclusion and selection criteria as a standardised declaration whenever feasible, or, failing that, a declaration on honour.

Het UEA bestaat uit een formele verklaring van de ondernemer dat de betrokken grond tot uitsluiting niet van toepassing is en/of dat aan het selectiecriterium is voldaan en bevat de relevante informatie die door de aanbestedende dienst wordt verlangd.
The ESPD shall consist of a formal statement by the economic operator that the relevant ground for exclusion does not apply and/or that the relevant selection criterion is fulfilled and shall provide the relevant information as required by the contracting authority.

1. Limiting such requirements, for example through use of a European Single Procurement Document (ESPD) consisting of an updated self-declaration, could result in considerable simplification for the benefit of both contracting authorities and economic operators.

Indien de aanbestedende dienst het bewijsstuk rechtstreeks kan verkrijgen door raadpleging van een databank conform lid 5, bevat het UEA ook de daartoe vereiste informatie, zoals het internetadres van de databank, alle identificatiegegevens en, in voorkomend geval, de benodigde verklaring van instemming.
Where the contracting authority can obtain the supporting documents directly by accessing a database pursuant to paragraph 5, the EPSD shall also contain the information required for this purpose, such as the internet address of the database, any identification data and, where applicable, the necessary declaration of consent.

1. Voor de toepassing van artikel 106, lid 10, van het Financieel Reglement aanvaardt de aanbestedende dienst het Uniform Europees Aanbestedingsdocument (UEA) als bedoeld in Richtlijn 2014/24/EU of, bij gebreke daarvan, een verklaring op erewoord, gedateerd en ondertekend, dat de ondernemer niet in een van de situaties als bedoeld in artikel 106, leden 1 en 4, en in artikel 107 van het Financieel Reglement verkeert of dat hij in een van de gevallen als bedoeld in artikel 106, lid 7, onder a), van het Financieel Reglement verkeert.

For the purpose of Article 106(10) of the Financial Regulation, the contracting authority shall accept the European Single Procurement Document (ESPD) referred to in Directive 2014/24/EU or, failing that, a declaration on honour, signed and dated, stating that the economic operator is not in one of the situations referred to in paragraphs 1 and 4 of Article 106 and in Article 107 of the Financial Regulation or that it is in one of the cases referred to in point (a) of Article 106(7) of the Financial Regulation.

3. 3. When receiving requests to participate or tenders, the contracting authority shall accept the ESPD or, failing that, a declaration on honour stating that the candidate or tenderer fulfils the selection criteria.
