Het recentste geconsolideerde IAO-verdrag betreffende arbeid op zee (2006) is zeer relevant voor de Europese sociale dialoog en de toekomstige normatieve werkzaamheden van de Gemeenschap en de lidstaten.
The very recent ILO consolidated maritime labour convention (2006) is particularly relevant to the European social dialogue and to the future regulatory activities of the Community and the Member States.

The European Border and Coast Guard, which includes the Agency and the national authorities of Member States which are responsible for border management, including coast guards to the extent that they carry out border control tasks, should fulfil its tasks in full respect for fundamental rights, in particular the Charter of Fundamental Rights of the European Union (‘the Charter’), the European Convention for the Protection of Human Rights and Fundamental Freedoms, relevant international law, including the United Nations Convention on the Rights of the Child, the Convention on the Elimination of All Forms of Discrimination Against Women, the Convention Relating to the Status of Refugees and obligations related to access to international protection, in particular the principle of non-refoulement, the United Nations Convention on the Law of the Sea, the International Convention for the Safety of Life at Sea, and the International Convention on Maritime Search and Rescue.

The implementation of this Regulation does not affect the division of competence between the Union and the Member States under the Treaties, or the obligations of Member States under international conventions such as the United Nations Convention on the Law of the Sea, the International Convention for the Safety of Life at Sea, the International Convention on Maritime Search and Rescue, the International Convention for the Prevention of Pollution from Ships, the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, and other relevant international maritime instruments.

The implementation of this Regulation does not affect the division of competence between the Union and the Member States or the obligations of Member States under the United Nations Convention on the Law of the Sea, the International Convention for the Safety of Life at Sea, the International Convention on Maritime Search and Rescue, the United Nations Convention against Transnational Organized Crime and its Protocol against the Smuggling of Migrants by Land, Sea and Air, the Convention Relating to the Status of Refugees, the Convention for the Protection of Human Rights and Fundamental Freedoms and other relevant international instruments.

5. juicht het toe dat de door de sociale partners gesloten overeenkomst en het voorstel van de Commissie voor een richtlijn van de Raad slechts minimale voorschriften bevatten, waardoor het de lidstaten en/of de sociale partners vrij staat maatregelen te treffen die gunstiger zijn voor werknemers in het betrokken gebied en die in essentie gelijkwaardig zijn aan de bepalingen in Deel A van het Verdrag betreffende arbeid op zee;
5. Welcomes the fact that the Agreement as concluded by the social partners and the Commission proposal provide only for minimum requirements, leaving the Member States and/or the social partners free to adopt measures which are more favourable to workers in the area concerned and substantially equivalent to the provisions of Part A of the Code of the Convention;

– gelet op onderstaande IAO-verdragen: nrs. 94 betreffende bepalingen ter regeling van arbeidsvoorwaarden (overheidscontracten); 87 betreffende de vrijheid van vereniging en bescherming van het recht tot het oprichten van vakverenigingen; 98 betreffende het recht zich te organiseren en collectief te onderhandelen; 117 Basisdoelen en -normen van het sociaal beleid, met name Deel IV; 154 betreffende het collectief onderhandelen; het IAO-verdrag betreffende arbeid op zee; en eveneens op het IAO-programma voor fatsoenlijk werk,
– having regard to the following ILO conventions: ILO-94 Labour Clauses (Public Contracts); ILO-87 Freedom of Association and Protection of the Right to Organise; ILO-98 Right to Organise and Collective Bargaining; ILO-117 Basic Aims and Standards of Social Policy, especially Part IV thereof; ILO-154 Collective Bargaining; ILO-MLC Maritime Labour Convention; having regard also to the ILO's Decent Work Agenda,

(4 bis) De Europese Gemeenschap wenst dan ook een spoedige ratificatie van het Verdrag betreffende arbeid op zee uit 2006 van de Internationale Arbeidsorganisatie, waarvan sectie 5.2.1 betrekking heeft op de verantwoordelijkheden van de havenstaat.

In deze mededeling zal de integratie van het geconsolideerd verdrag betreffende arbeid op zee in het Gemeenschapsrecht onder de loep worden genomen. This Communication will explore the integration into Community law of the Consolidated Maritime Labour Convention, to be adopted by the International Labour Organisation (ILO) during the 94 Maritime Session of the International Labour Conference in Geneva (7-23 February 2006), possibly through an agreement of social partners.
