Overwegende dat deze verordening geenszins vooruitloopt op de uitwerking en uitlegging van de verdragen van de Internationale Maritieme Organisatie (IMO );
Whereas this Regulation does not in any way prejudge the preparation and interpretation of conventions by the International Maritime Organization (IMO);

Overwegende dat de afgifte van de internationale certificaten inzake veiligheid en voorkoming van verontreiniging, waarin bij het Verdrag van 1974 voor de beveiliging van mensenlevens op zee ( SOLAS 1974 ), het Verdrag van 1966 betreffende de uitwatering van schepen ( LL 1966 ), het Verdrag van 1973 ter voorkoming van verontreiniging door schepen, zoals gewijzigd bij het Protocol van 1978 ( MARPOL 1973/1978 ) en bij de door de Internationale Maritieme Organisatie ( IMO ) aangenomen resoluties met een dwingend karakter is voorzien, onder de verantwoordelijkheid van de Staten valt; dat de afgifte van certificaten door particuliere instanties namens een Lid-Staat, overeenkomstig de verdragen, ook geschiedt onder de verantwoordelijkheid van de Lid-Staat, zoals bepaald in die verdragen;
Whereas the issue of international certificates for safety and pollution prevention, provided for under the 1974 International Convention for the Safety of Life at Sea (1974 Solas), the 1966 International Convention on Load Lines (LL 1966), the 1973 International Convention for the Prevention of Pollution from Ships, as amended by the 1978 Protocol (Marpol 73/78) and the related resolutions of mandatory status adopted by the International Maritime Organization (IMO), is the responsibility of States; whereas, where private organizations issue certificates on behalf of a Member State, in accordance with the said Conventions, they also do so on that Member State's responsibility, as defined in those Conventions;
