(7) The European Parliament emphasised in its resolution of 7 September 2010 on the interconnection of business registers that the usefulness of the project for the further integration of the European Economic Area can only be exploited if all Member States take part in the network, and that better and easier access to information is necessary in order to assist small and medium-sized enterprises, which are a key element in the backbone of the European economy and the main motor for creating jobs, economic growth and social cohesion in Europe, as it helps to lighten the administrative burdens of such enterprises.

In dit verband heeft het Hof van Justitie verklaard dat een gedeeltelijke verlichting van de sociale lasten welke op een onderneming drukken, staatssteun in de zin van artikel 87, lid 1, van het Verdrag is, indien die maatregel is bedoeld om die onderneming gedeeltelijk vrij te stellen van de geldelijke lasten die voortvloeien uit de normale toepassing van het algemene stelsel van sociale voorzieningen, zonder dat deze vrijstelling gerechtvaardigd is door de aard of de opzet van dit stelsel (35).
The Court of Justice has held in this respect that a partial reduction of social charges devolving upon an undertaking constitutes aid within the meaning of Article 87(1) of the Treaty if that measure is intended partially to exempt that undertaking from the financial charges arising from the normal application of the general social security system, without there being any justification for this exemption on the basis of the nature or general scheme of this system (35).

To be more precise, the Court stated that a reduction in social charges constitutes State aid when such a measure is ‘intended partially to exempt undertakings in a particular sector from the pecuniary social charges arising from the normal application of the general social security system when such an exemption is not justified by the nature or general scheme of that system’ (186).

Uit de jurisprudentie en de beschikkingspraktijk (191) van de Commissie vloeit voort dat de Commissie, om uit te sluiten dat er bij de maatregel in kwestie sprake is van staatssteun, dient na te gaan of de maatregel de SNCM geen verlichting oplevert van de lasten die voortvloeien uit haar normale bedrijfsvoering, dat wil zeggen in dit geval van de lasten die voortvloeien uit de normale toepassing van de sociale wetgeving die op de sector van toepassing is bij beëindiging van een arbeidsovereenkomst.
It follows from the case-law and the Commission’s past practice (191) that, in order to rule out the aid nature of the measure in question, the Commission must ascertain that the measure does not exempt SNCM from having to pay charges arising out of its day-to-day operations, that is, in the present case, charges arising out of the normal application of social legislation applicable to the sector in respect of employment contracts.
