Ten tweede stelt de Commissie dat de nota van 28 juli 2009, die verzoekster het opschrift „Klacht” in de zin van artikel 90, lid 2, van het Statuut heeft gegeven, slechts een verzoek om toezending van stukken was en niet de minimuminhoud had die de definitie van het begrip voorafgaande administratieve klacht in de zin van de bepalingen van het Statuut vereist. Om die reden kan deze nota niet tot gevolg hebben gehad dat de termijn van drie maanden en tien dagen om beroep bij het Gerecht in te stellen, werd opgeschort.
Secondly, the Commission contends that the note of 28 July 2009, which the applicant entitled ‘Complaint’ within the meaning of Article 90(2) of the Staff Regulations, was no more than a request for documents, and did not have the minimum content required for a ‘prior administrative complaint’ within the meaning of the provisions of the Staff Regulations, which is why that note did not have the effect of suspending the time-limit of three months and ten days before the matter could be referred to the Tribunal.
