TRADUCTIONS EN CONTEXTE

1. In afwijking van artikel 65 schrijft de volledig werkloze die als grensarbeider zeer recent tijdvakken van verzekering als zelfstandige heeft vervuld of tijdvakken van arbeid als zelfstandige die worden erkend voor het verlenen van het recht op een werkloosheidsuitkering, en van wie de lidstaat van zijn woonplaats in een kennisgeving heeft laten weten dat geen enkele categorie zelfstandigen in die lidstaat onder het stelsel van werkloosheidsuitkeringen kan vallen, zich in bij en stelt zich ter beschikking van de diensten voor arbeidsvoorziening in de lidstaat waar hij het laatst als zelfstandige werkzaamheden heeft verricht, en blijft wanneer hij een uitkering aanvraagt voldoen aan de voorwaarden zoals vastgelegd in de wetgeving van die lidstaat.
1. By way of derogation from Article 65, a wholly unemployed person who as a frontier worker most recently completed periods of insurance as a self-employed person or periods of self-employment recognised for the purposes of granting unemployment benefits and whose Member State of residence has submitted notification that no possibility exists for any category of self-employed persons to be covered by the unemployment benefits system in that Member State, shall register with and make himself/herself available to the employment services in the Member State in which he/she pursued his/her last activity as a self-employed person and continuously adhere to the conditions laid down under the legislation of the latter Member State when he/she applies for benefits.

5. beklemtoont dat de richtlijn verder reikt dan de toegang tot werkgelegenheid, zelfstandig verrichte arbeid en beroepsarbeid en ook terreinen omvat zoals onderwijs, sociale bescherming inclusief sociale zekerheid en gezondheidszorg, sociale uitkeringen en toegang tot en levering van goederen en diensten ter waarborging van de ontwikkeling van democratische en tolerante samenlevingen waaraan allen, ongeacht ras of etnische afstamming, deelnemen;

Stresses that the Directive goes beyond access to employment, self-employment and occupation, and also applies to areas such as education, social protection including social security and healthcare, social benefits and access to and the supply of goods and services in order to safeguard the development of democratic and tolerant societies that allow the participation of all irrespective of racial or ethnic origin;

(ii)for the purposes of the provisions of Article 46 (2) of the Regulation, periods before 1 October 1959 during which the employed or self-employed person resided in the territory of the Netherlands after the age of 15 years or during which, whilst residing in the territory of another Member State, he pursued an activity as an employed person in the Netherlands for an employer established in that country shall also be considered as periods of insurance completed under Netherlands legislation relating to general insurance for widows and orphans'.

Toepassing van de Nederlandse algemene weduwen- en wezenwet a) Als tijdvakken van verzekering, vervuld krachtens de Nederlandse algemene weduwen- en wezenwet, worden bij de toepassing van artikel 46, lid 2, van de verordening mede aangemerkt tijdvakken gelegen vóór 1 oktober 1959, gedurende welke de werknemer of zelfstandige na het bereiken van de 15-jarige leeftijd op Nederlands grondgebied heeft gewoond of gedurende welke hij, op het grondgebied van een andere Lid-Staat wonende, in Nederland arbeid heeft verricht in dienst van een in Nederland gevestigde werkgever.
3. Application of Netherlands legislation on general insurance for widows and orphans (a) For the purposes of the provisions of Article 46 (2) of the Regulation, periods before 1 October 1959 during which the employed or self-employed person resided in the territory of the Netherlands after the age of 15 years or during which, whilst residing in the territory of another Member State, he pursued an activity as an employed person in the Netherlands for an employer established in that country shall also be considered as periods of insurance completed under Netherlands legislation relating to general insurance for widows and orphans.
