The European Commission has today decided to refer the Republic of Italy to the Court of Justice of the European Union for not adequately implementing EU rules on compensation for victims of crime (Directive 2004/80/EC).

Strongly welcomes the new Victims and Land Restitution Law (also known as ‘Ley 1448’) which came into effect in Colombia on 1 January 2012, guaranteeing financial compensation and restitution of land for the almost 4 million victims of the country's armed conflict and violence over the past 50 years; emphasises the massive financial effort of the Colombian Government, which is estimated at more than USD 25 billion for the next ten years, representing about EUR 160 million per month; underlines the need for thorough monitoring and evaluation of the implementation of this law in close consultation with civil society, in particular regarding the protection of returnees;

Recognises the importance of the Act on Compensation of Victims of Terrorism, which covers victims of acts of terrorism as well as victims of counter-terrorism operations by the State; regrets that the Act does not fully meet expectations because the loss assessment commissions under the Act are ill-equipped to fulfil their tasks appropriately;

7. onderkent het belang van de wet inzake de schadeloosstelling van slachtoffers van terrorisme, die zowel van toepassing is op slachtoffers van terreurdaden als op slachtoffers van door de staat uitgevoerde terrorismebestrijdingsoperaties; betreurt het dat deze wet niet ten volle aan de verwachtingen voldoet omdat de commissies voor schadebeoordeling wettelijk niet goed zijn toegerust om hun taken naar behoren te kunnen vervullen;

Recognises the importance of the Act on Compensation of Victims of Terrorism, which extends to victims of acts of terrorism as well as to victims of counter-terrorism operations by the State; regrets that the Law does not fully meet expectations because the loss assessment commissions under the Law are ill-equipped to fulfil their tasks appropriately;

In de komende jaren zal de Commissie maatregelen nemen om de huidige EU-regelgeving inzake schadeloosstelling van slachtoffers van misdrijven doeltreffender te maken. Zij wil ervoor zorgen dat slachtoffers daadwerkelijk toegang tot schadeloosstelling hebben, met name wanneer het misdrijf in het buitenland is gepleegd.
In the coming years, the Commission will take action to strengthen existing EU rules on compensation to victims of crime to ensure they have proper access to compensation, particularly when they've become a victim abroad.

De richtlijn zal bepalingen inzake toegang tot schadeloosstelling in grensoverschrijdende situaties bevatten, alsmede een bepaling die garandeert dat alle lidstaten nationale bepalingen zullen vaststellen die schadeloosstelling van slachtoffers van op hun respectieve grondgebieden gepleegde opzettelijke geweldmisdrijven garanderen.
The Directive will contain provisions on access to compensation in cross-border cases and a provision guaranteeing that Member States will put in place relevant national provisions to ensure compensation to victims of violent intentional crime committed in their respective territories.
