BESEFT dat de consumenten doeltreffende instrumenten moeten krijgen voor het oplossen van hun problemen bij het online winkelen over de grens; dat de wetgeving inzake gegevens­bescherming geactualiseerd moet worden; dat de Europese auteursrechtregeling moet worden gemoderniseerd, wil de Unie haar concurrentievoorsprong behouden en willen er kansen ont­staan voor nieuwe bedrijfsmodellen, waarbij tegelijkertijd een hoge mate van bescherming van de intellectuele-eigendomsrechten wordt gegarandeerd en de culturele verscheidenheid in aanmerking wordt genomen; dat het land van verblijf van de consument geen belemmering of discriminatiegrond mag vormen of worden, indien hierdoor de goede werking van de een­gemaakte markt wordt verstoord; dat de bestaande wetgeving beter moet worden gehand­haafd;
10. RECOGNISES the need to provide consumers with effective instruments to solve their problems when shopping cross-border on-line; to update legislation on data protection; to modernise Europe’s copyright regime with a view to ensure the Union’s competitive edge and unleash possibilities for new business models while ensuring a high level of protection of intellectual property rights and taking into account cultural diversity; to remove barriers and discriminations based on the country of residence of consumers and to avoid the creation of new ones, where they hamper the proper functioning of the single market; to better enforce existing legislation;

te evalueren of verschillen in de nationale wetgeving inzake privacy en elektronische communicatie, daaronder begrepen de wetten ter uitvoering van de Richtlijnen 2002/58/EG en 95/46/EG , een obstakel zouden kunnen vormen voor effectieve grensoverschrijdende handhaving; de bestaande initiatieven ter verbetering van de samenwerking op het gebied van handhaving, gegevensuitwisseling en consumentenbescherming binnen de EU, met inbegrip van het informele netwerk van contactpunten van de voor "spam" bevoegde autoriteiten, voort te zetten; na te gaan of de komende financieringsprogramma's van de Gemeenschap gebruikt kunnen worden om de vooruitgang te consolideren die is geboekt bij het vinden van technische en andere oplossingen om de verspreiding van "spam" tegen te gaan; in samenwerking met de lidstaten, een actieve rol te spelen bij het verder ontwikkelen van de internationale samenwerking met derde landen.
evaluate whether differences in the national laws on privacy and electronic communications, including those implementing Directives Nos 2002/58/EC and 95/46/EC might represent an obstacle to effective cross-border enforcement; continue the existing initiatives aimed at improving cooperation on enforcement, information exchange and consumer protection at the intra-EU level, including the informal Contact Network of Spam Authorities; consider whether forthcoming Community funding Programmes might be used to consolidate progress on technical and other solutions aimed at countering the diffusion of "spam"; take an active role, in cooperation with the Member States, in further developing international cooperation with third countries.
