Notes with concern the Commission's Report on the progress made by Bulgaria under the Cooperation and Verification Mechanism with a view to further efforts needed in order to demonstrate tangible results in the monitored sectors; calls upon the effective implementation of the established legislative and institutional framework; notes with concern the Report's statement that the Supreme Judicial Council (SJC) has not used the new powers given to it accordingly, aimed at effectively managing and leading the judiciary through a comprehensive reform process; welcomes the efforts by the Bulgarian government to renew the SJC with a mandate able of implementing fundamental reform through the following new rules: public hearings of the candidates for SJC, clear criteria for their professional and educational qualification and vision for the efficiency, accountability and integrity of the judiciary; acknowledges the fact that the new specialised structures put in place illustrate a commitment to adapting the current structures to tackle organised crime more effectively; takes note, however, that the Report suggests that these new instruments have not yet delivered the expected results regarding important cases; notes with great concern that investigations into alleged corruption and abuse of office by magistrates have received a particular weak response from the judiciary; is fearful, furthermore, that a weak implementation of Public Procurement legislation could result in an important source of corruption, serious violations of Union procurement rules as well as a poor delivery of public goods with a European added value and waste of Union public money; welcomes the amended public procurement law, establishing the ex-ante control on tender procedures to guarantee the proper spending of the public resources; calls on the Commission steadfastly and determinedly to insist, as far as the Bulgarian institutions are concerned, that the Commission's recommendations a ...

86. is van oordeel dat, mochten controleurs uit de particuliere sector bij de externe controle van de rekeningen van de agentschappen worden betrokken, de selectie en benoeming van de particuliere controleurs dient te geschieden overeenkomstig de vigerende regelgeving, waaronder die betreffende transparantie van overheidsopdrachten, en dat passende controlemechanismen moeten worden ingevoerd om ervoor te zorgen dat werkzaamheden in verband met de wettigheid en regelmatigheid van ontvangsten en uitgaven en de betrouwbaarheid van de rekeningen van de agentschappen overeenkomstig de vereiste normen worden uitgevoerd; is eveneens van oordeel dat aspecten van zulke uitbestede externe controles, met inbegrip van de gerapporteerde controlebevindingen, volledig moeten blijven vallen onder de verantwoordelijkheid van de Rekenkamer, die alle vereiste administratieve en aanbestedingsprocedures zal moeten beheren en uit haar eigen begroting zal moeten financieren, zonder aanspraak te kunnen maken op een aanvullende begroting, aangezien deze taak onder de bevoegdheid van de Rekenkamer valt; is voorts van oordeel dat de huidige crisis geen ruimte biedt voor aanvullende begrotingen voor de uitvoering van taken die onder de bevoegdheid vallen van één EU-instelling, in voorkomend geval de Rekenkamer;

Considers that, if private sector auditors have to be involved in the external audit of Agencies' accounts, the selection and appointment of the private auditors should be done in conformity with the applicable rules, including those on transparent public procurement, and appropriate control mechanisms should be put in place, in order to ensure that work on the legality and regularity of revenue and expenditure and the reliability of Agencies' accounts is carried out in accordance with the required standards; considers also that aspects of such outsourced external audits, including the reported audit findings, have to remain the full responsibility of the Court of Auditors, which will have to manage all administrative and procurement procedures required and finance these from its own budget without asking for a supplementary budget, as this task is under the Court of Auditors competence; moreover, the current crisis does not allow for additional budgets to perform tasks which are under one Union institution, in this case the Court of Auditors;

Daarom dienen de lidstaten onverwijld de OESO-aanbevelingen inzake corruptie bij internationale handelstransacties in praktijk te brengen, dient de Commissie actief deel te nemen aan de selectie van de ontwikkelingsprogramma's en het opzetten en beheren van de diverse projecten, en dienen de aanbestedingsprocedures te worden vereenvoudigd.
Member States need urgently to implement the OECD recommendations on bribery in international business transactions. To reduce the incidence of corruption the Commission should play a more prominent role in the choice of development programme, the design and management of projects and simplify the tender procedures.
