Overwegende dat het, gelet op de juridische tradities in de meeste Lid-Staten, niet dienstig is de aansprakelijkheid buiten schuld van de producent aan een financieel maximum te binden; dat het evenwel, aangezien er uiteenlopende tradities bestaan, mogelijk lijkt toe te laten dat een Lid-Staat van het beginsel van de onbeperkte aansprakelijkheid kan afwijken door een grens te stellen aan de volledige aansprakelijkheid van de producent voor dood of lichamelijk letsel veroorzaakt door identieke artikelen met hetzelfde gebrek, op voorwaarde dat deze beperking op een zo hoog niveau komt te liggen dat een adequate bescherming van de consument en een correcte werking van de gemeenschappelijke markt worden gewaarborgd;
