Moeten artikel 2, lid 1, artikel 3, sub a, en bijlagen IA en IB van richtlijn 2002/96/EG (1) van het Europees Parlement en de Raad van 27. januari 2003 betreffende afgedankte elektrische en elektronische apparatuur en/of artikel 2, lid 1, sub a, artikel 3, lid 1, en bijlagen I en II van richtlijn 2012/19/EU (2) van het Europees Parlement en de Raad van 4 juli 2012 betreffende afgedankte elektrische en elektronische apparatuur, aldus worden uitgelegd dat aandrijvingen voor (garage-)poorten die werken op elektrische spanningen van circa 220 V tot 240 V, die bedoeld zijn om tezamen met de garagepoort in de technische voorzieningen van gebouwen te worden ingebouwd, onder het begrip elektrische en elektronische apparatuur, meer bepaald het begrip elektrische en elektronische werktuigen, vallen?
Must Articles 2(1) and 3(a) of, and Annexes IA and IB to, Directive 2002/96/EC (1) of the European Parliament and of the Council of 27 January 2003 on waste electrical and electronic equipment and/or Articles 2(1)(a) and 3(1)(a) of, and Annexes I and II to, Directive 2012/19/EU (2) of the European Parliament and of the Council of 4 July 2012 on waste electrical and electronic equipment be interpreted as meaning that operating devices for (garage) doors with an electric voltage of approximately 220 to 240 volts, which are designed to be incorporated into the building structure together with the (garage) door, come within the concept of electrical and electronic equipment, in particular the concept of electrical and electronic tools?

b) „afgedankte elektrische en elektronische apparatuur” of „AEEA”: elektrische of elektronische apparaten die afvalstoffen vormen in de zin van artikel √ 3, punt 1, van Richtlijn 2008/xx/EG betreffende afvalstoffen ∏ 1, onder a), van Richtlijn 75/442/EEG, daaronder begrepen alle onderdelen, subeenheden en verbruiksmaterialen die deel uitmaken van het product op het moment dat het wordt afgedankt.

Voorts beoogt deze richtlijn een verbetering van de milieuprestaties van alle marktdeelnemers die bij de levenscyclus van elektrische en elektronische apparatuur betrokken zijn, zoals producenten, distributeurs en consumenten en in het bijzonder de marktdeelnemers die rechtstreeks betrokken zijn bij de verwerking van afgedankte elektrische en elektronische apparatuur.
