Volgens artikel 9, lid 5, van de basisverordening inzake antidumping is op individuele producent-exporteurs in landen zonder markteconomie aan wie geen behandeling als marktgerichte onderneming ingevolge artikel 2, lid 7, onder c), van de basisverordening inzake antidumping is toegekend, het voor het gehele land geldende recht van toepassing, tenzij de exporteurs in kwestie kunnen aantonen dat zij voldoen aan de criteria voor een individuele behandeling als bedoeld in artikel 9, lid 5, van de basisverordening inzake antidumping.
Article 9(5) of the Basic Anti-Dumping Regulation provides that individual exporting producers in non-market economy countries which do not receive market economy treatment pursuant to point (c) of Article 2(7) of the Basic Anti-Dumping Regulation will be subject to a countrywide duty rate unless such exporters can demonstrate that they meet the conditions for individual treatment (‘IT’) set out in Article 9(5) of the Basic Anti-Dumping Regulation.
