The Commission should be empowered to adopt delegated acts in accordance with Article 290 TFEU in order to determine the rules for the calculation of the interest rate to be applied in the event of a decision on the recovery of misused amounts from the Fund and to guarantee the rights to good administration and of access to documents of beneficiaries in procedures in respect of such a recovery; determine the type of contributions to the Fund and the matters for which contributions are due, and the manner in which the amount of the contributions is calculated and the way in which they are to be paid; specify registration, accounting, reporting and other rules necessary to ensure that the contributions are paid fully and in a timely manner; determine the annual contributions necessary to cover the administrative expenditure of the Board before it becomes fully operational; determine the contribution system for institutions that have been authorised to operate after the Fund has reached its target level; determine the criteria for the spreading out in time of the contributions; determine the criteria for determining the number of years by which the initial period for reaching the target level can be extended; determine the criteria for establishing the annual contributions when the available financial means of the Fund diminishes below its target level after the initial period; determine the measures to specify the circumstances and conditions under which ex-post contributions may be temporarily deferred for individual institutions; and determine the detailed rules for the administration of the Fund and general principles and criteria for its investment strategy.

7. is ingenomen met de door de instellingen getroffen maatregelen voor de reorganisatie van de codering, opstelling, registratie en distributie van documenten, met vermelding van de auteur, het soort document en andere informatie, hetgeen voor de tracering van documenten in elke instelling noodzakelijk is; stelt echter vast, dat op interinstitutioneel niveau nog bijna niets is gebeurd en de instellingen - ondanks de middelen die daarvoor sinds 1987 in het kader van de programma's INSIS en IDA zijn geïnvesteerd - het volgende nog niet hebben vastgelegd:

Welcomes the measures taken within the institutions for the reorganisation of the coding process, production, filing and distribution of documents, making it possible to identify the authors, the nature of the document and other information necessary for the traceability of documents within each institution; remarks however that at the interinstitutional level almost everything still remains to be done and that, notwithstanding the resources invested since 1987 under the INSIS and IDA programmes, the institutions have not yet established:

1. Member States shall provide that authors who are nationals of third countries and, subject to Article 8(2), their successors in title shall enjoy the resale right in accordance with this Directive and the legislation of the Member State concerned only if legislation in the country of which the author or his/her successor in title is a national permits resale right protection in that country for authors from the Member States and their successors in title.

Uw rapporteur stelt vast dat de voorgestelde voorschriften inzake vertrouwelijkheid en classificatie van Europol-documenten haaks staan op de beginselen in verordening 1049/2001: de code "beperkt toegankelijk" komt in de verordening niet voor, terwijl "Europol Niet geclassificeerd, niet voor algemene verspreiding", indruist tegen de beginselen van toegang tot documenten die bepalen dat alle documenten algemeen toegankelijk zijn tenzij hiervoor bijzondere uitzonderingsregelingen gelden.
The rapporteur notes that the proposed rules on confidentiality and classification of Europol documents are contrary to the principles in Regulation 1049/2001: the code ‘restricted’ is not mentioned in the EC Regulation, while ‘Europol Unclassified – not for public dissemination’ is contrary to the principles on access to documents, that provide for all documents to be public except those that are covered by specific exceptions.

De preventie moet worden vergemakkelijkt door : - de juiste en volledige identificatie van de instanties die verantwoordelijk zijn voor de afgifte van de vergunningen, - de uitbouw en het gebruik, met medewerking van de beroepssectoren, van een netwerk van proef- en analysecentra, die het mogelijk maken de fraude op te sporen en de oorsprong van de produkten te helpen bepalen, - de uniforme en doeltreffende toepassing door de bevoegde administratieve instanties in de Lid-Staten, van de rechtstreeks- vervoerregel bij preferentiële regelingen, - een betere omschrijving van sommige administratieve documenten en van bepaalde formaliteiten om de controles te vergemakkelijken, - het gebruik van elektronische middelen om vervalste uitvoervergunningen op te sporen.
Preventive action should be facilitated through: - accurate and detailed identification of the authorities responsible for issuing licenses; - development and use with industry assistance of a network of centres for analyzing and testing, to enable the detection of fraud and the determination of product origin; - uniform and effective application, by the competent authorities of the Member States, of the rule of direct transportation in the framework of preferential arrangements; - better definition of a number of administrative documents and of certain formalities in order to facilitate checks; - the use of electronic means for the detection of falsified export licences.
