IN-CONTEXT TRANSLATIONS

Bij Beschikking 2009/831/EG (1), vastgesteld op basis van artikel 299, lid 2, van het EG-Verdrag (thans artikel 349 van het verdrag betreffende de werking van de Europese Unie (VWEU)) werd Portugal gemachtigd een verlaagd accijnstarief toe te passen op lokaal geproduceerde en verbruikte rum en likeuren in de autonome regio Madeira en op lokaal geproduceerde en verbruikte likeuren en eaux de vie in de autonome regio de Azoren, die lager mag zijn dan het bij Richtlijn 92/84/EEG van de Raad (2) vastgestelde minimumaccijnstarief maar niet meer dan 75 % lager dan het normale nationale accijnstarief voor alcohol.
Council Decision 2009/831/EC (1), adopted on the basis of Article 299(2) of the EC Treaty (now Article 349 of the Treaty on the Functioning of the European Union (TFEU)), authorised Portugal to apply a reduced rate of excise duty in the autonomous region of Madeira on locally produced and consumed rum and liqueurs and in the autonomous region of the Azores on locally produced and consumed liqueurs and eaux-de-vie which may be lower than the minimum rate of excise duty set by Council Directive 92/84/EEC (2), but not more than 75 % lower than the standard national excise duty on alcohol.

By way of derogation from Article 110 TFEU, Portugal is hereby authorised to apply a rate of excise duty lower than the full rate on alcohol laid down in Article 3 of Directive 92/84/EEC in the autonomous region of Madeira on locally produced and consumed rum and liqueurs, and in the autonomous region of the Azores on locally produced and consumed liqueurs and eaux-de-vie.

Volgens de toelichting van de Commissie werd Portugal bij Beschikking 2009/831/EG van de Raad van 10 november 2009, aangenomen op basis van artikel 299, lid 2, van het EG-Verdrag (thans artikel 349 VWEU) gemachtigd om de accijns op lokaal geproduceerde en verbruikte rum en likeuren in de autonome regio Madeira en op lokaal geproduceerde en verbruikte likeuren en eaux de vie in de autonome regio de Azoren tot en met 31 december 2013 te verlagen.
