Regulation (EU) No 1024/2013 vested the ECB with some supervisory tasks and entitled the latter to impose on the credit institutions it supervises: (a) administrative pecuniary penalties when these institutions breach a requirement under directly applicable Union law in relation to which administrative pecuniary sanctions shall be made available to competent authorities under the relevant Union law; and (b) sanctions in accordance with Regulation (EC) No 2532/98 in case of a breach of ECB regulations or decisions (hereinafter jointly referred to as ‘administrative penalties’).

Op grond van dit verdrag kan de staat van veroordeling slechts om de tenuitvoerlegging van een sanctie door een andere verdragsluitende staat verzoeken, indien aan één of meer van de in artikel 5 genoemde voorwaarden is voldaan: a) de veroordeelde heeft zijn vaste woonplaats in de andere staat, b) de tenuitvoerlegging van de sanctie in de andere staat schept naar verwachting betere kansen voor de reclassering van de veroordeelde, c) het betreft een sanctie die vrijheidsbeneming meebrengt, die in de andere staat kan worden ten uitvoer gelegd in aansluiting op een andere sanctie die vrijheidsbeneming meebrengt en die de veroordeelde in die staat ondergaat of moet ondergaan, d) de andere staat de staat van herkomst van de veroordeelde is en zich reeds bereid heeft verklaard tot tenuitvoerlegging van de sanctie, e) de staat van veroordeling meent dat hij zelf niet de sanctie ten uitvoer kan leggen, ook niet met behulp van uitlevering, en dat de andere staat dat wel kan. Bovendien moet het vonnis dat in de verzoekende staat is gewezen, onherroepelijk en uitvoerbaar zijn en moet het strafbare feit waarvoor de straf is uitgesproken, eveneens een strafbaar feit zijn volgens de wetgeving van de aangezochte staat (vereiste van "dubbele strafbaarheid" [76]).
According to the Convention, the sentencing State may request another Contracting State to enforce a sentence only if one or more of the conditions set out in Article 5 are fulfilled, namely: (a) if the sentenced person is ordinarily resident in the other State; (b) if the enforcement of the sentence in the other State is likely to improve the prospects for the social rehabilitation of the sentenced person; (c) if, in the case of a sentence involving deprivation of liberty, the sentence could be enforced following the enforcement of another sentence involving deprivation of liberty which the sentenced person is undergoing or is to undergo in the other State; (d) if the other State is the State of origin of the sentenced person and has declared itself willing to accept responsibility for the enforcement of that sentence; or (e) if it considers that it cannot itself enforce the sentence, even by having recourse to extradition, and that the other State can. In addition, the judgment handed down in the requesting State must be final and enforceable and the offence in respect of which the sentence has been passed must also constitute an offence under the law of the requested State ("double criminality" requirement [76]).
