The agreement aims to ensure that adequate rules on the protection of intellectual property are applied in all member countries, on the basis of the basic obligations laid down by the World Intellectual Property Organisation (WIPO) in the various conventions on intellectual property rights (the Paris Convention for the Protection of Industrial Property, the Berne Convention for the Protection of Literary and Artistic Works, the Rome Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organisations, and the Washington Treaty on Intellectual Property in Respect of Integrated Circuits).

Stresses the importance of continuing the process of reform in the area of freedom of thought, conscience and religion by enabling religious communities to obtain legal personality, by eliminating all restrictions on the training, appointment, legal residence and succession of the clergy, and by ensuring adequate implementation of all relevant ECtHR rulings and the recommendations of the Venice Commission; stresses, in this regard, the need to promote dialogue with the Alevi community, to give proper recognition to Cem houses as places of worship, to allow the reopening of the Halki Greek Orthodox Seminary and lift all obstacles to its proper functioning, and to allow the official use of the ecclesiastical title of the Ecumenical Patriarch; asks Turkey’s relevant authorities to address all outstanding issues related to the restitution of land belonging to the Mor Gabriel monastery and other Syriac church land claims; recalls the importance of adequately implementing the Venice Commission recommendations on Imbros and Tenedos with regard to the protection of property and educational rights; underlines the need to fully respect, in line with EU values, the right to different lifestyles, both secular and faith-based, and to maintain the separation of state and religion; underlines the importance of protecting the rights of minorities; expresses regret about the fact that, after the abolition of the previous law two years ago and due to the existing legal vacuum, it is not possible for non-Muslim charitable foundations to elect their governing bodies;

(d) As their successful implementation will depend on this, the Guidelines should offer clarity in the definitions used and the appropriate and full protection of the right to freedom of religion or belief, in accordance with international law, in its private and public expressions, as well as in its individual, collective and institutional dimensions, including the right to believe or not to believe, the right to change one’s religion or belief, the freedom of expression, assembly and association, as well as the right of parents to educate their children according to their moral convictions – i.e. religious or non-religious; clear definitions and full protection are also required as regards the recognition of the legal personality of religious and belief-based institutions and respect for their autonomy, the right to conscientious objection, the right to asylum, the right to observe days of rest and to celebrate holidays and ceremonies in accordance with the precepts of one’s religion or belief, and the fundamental right to protection of one’s property;

Successful implementation of the Guidelines will depend on the clarity of the definitions used, including the right to religious education of children, freedom of assembly and freedom of association, freedom of expression, the right to conscientious objection to military service, the right to asylum, and the fundamental right to protection of property.

9. Considers that fundamental institutional changes should be promoted in developing countries and must include building capacity for the provision of: technical assistance, bodies which encourage social reforms (such as agrarian reform) legal security, measures to combat corruption,protection of property ownership and rights, properly functioning courts (particularly for small claims) access to justice, a banking network with easy access to opening bank and savings accounts for small account holders, the empowerment of SMEs through the easy formation of limited liability companies, limited partnerships, accounting, auditing and bookkeeping functions, the availability of incubator, micro-credit, venture, and development capital and loans, the establishment of an information technology sector, training centres and schools for basic computer operations and the establishment of technical colleges and business schools;

5. For the purpose of this Agreement, intellectual property includes in particular copyright, including the copyright on computer programmes, and neighbouring rights, including artistic designs, and industrial property which includes utility models, patents including patents for bio-technological inventions and plant varieties or other effective sui generis systems, industrial designs, geographical indications including appellations of origin, trademarks for goods or services, topographies of integrated circuits as well as the legal protection of data bases and the protection against unfair competition as referred to in Article 10a of the Paris Convention for the Protection of Industrial Property and protection of undisclosed confidential information on know how.
