Notes that the scope of the discharge procedure should cover not only the budget implementation and the managerial activities of the Secretary-General and Administration for the financial year 2012, but also the decisions taken by its governing bodies, i.e. its President, Bureau and Conference of Presidents; stresses that Parliament, in a critical scrutiny of the institution's financial management, grants discharge not to the Secretary-General, but rather, to its President;

8. neemt nota van de mededeling van zijn secretaris-generaal dat er momenteel in de parlementaire Administratie geen tuchtrechtelijke procedures aanhangig zijn; juicht het toe dat het Bureau reeds op 1 december 1999, dus al vóór de beraadslagingen over de kwijting voor 1998, op voorstel van de secretaris-generaal een bestuurlijk onderzoek heeft ingesteld; neemt kennis van het besluit van het Bureau van 13 juni 2000 om in verband met de zaak-Frederiksen geen eis tot schadevergoeding uit hoofde van artikel 22 van het Ambtenarenstatuut in te stellen; neemt er nota van dat dit besluit berust op het feit dat bij het bestuurlijk onderzoek geen aanknopingspunten konden worden vastgesteld voor "grove schuld” van afzonderlijke personen, als bedoeld in artikel 22 van het Ambtenarenstatuut; wijst er evenwel op dat het bestuurlijk onderzoek zowel problemen bij de interne besluitvorming aan het licht heeft gebracht als de neiging om procesrisico's in relatie tot zogenaamde "principiële” overwegingen te veronachtzamen; trekt uit het bovenstaande de conclusie dat een hernieuwde beoordeling van de zaak en een nieuwe inschatting van de procesrisico's op een aanzienlijk eerder tijdstip op hun plaats zouden zijn geweest; herinnert aan paragraaf 23 van voornoemde resolutie van 13 april 2000, waarin de Juridische Dienst wordt verzocht het Bureau voorafgaande aan diens besluiten te informeren over procesrisico's, met name in het licht van reeds gewezen arresten in personeelskwesties; juicht het besluit van het Bureau van 13 juni 2000 toe om ondervoorzitters Lienemann en Provan opdracht te geven na te gaan of verdere interne bestuurlijke hervormingen noodzakelijk zijn om soortgelijke procesontwikkelingen te voorkomen; gelast zijn Bureau de bevoegde commissies op de hoogte te stellen van zijn conclusies terzake;
8. Notes the Secretary-General's statement that at present no disciplinary proceedings are pending within Parliament's administration; welcomes the fact that on 1 December 1999, i.e. even before the deliberations on the discharge for 1998, the Bureau, at the proposal of the Secretary-General, started an administrative inquiry; notes the Bureau decision of 13 June 2000, in connection with the Frederiksen case, not to seek redress as provided for by Article 22 of the Staff Regulations; notes that this decision is based on the consideration that the administrative inquiry did not reveal evidence of "serious misconduct" by individuals as referred to in Article 22 of the Staff Regulations; points out, however, that the administrative inquiry revealed both problems with internal decision-making procedures and a tendency to neglect risks associated with court cases in relation to alleged considerations of "principle"; concludes from the course of events that it would have been appropriate to review the case and reappraise the risks associated with legal proceedings at a considerably earlier stage; recalls paragraph 23 of its above-mentioned resolution of 13 April 2000, calling on the Legal Service to inform the Bureau about the risks of court cases before the Bureau takes its decisions, particularly in the light of previous judgements on staff matters; welcomes the Bureau decision of 13 June 2000 instructing Vice-Presidents Lienemann and Provan to examine whether further internal administrative reforms are needed in order to avoid similar outcomes; instructs its Bureau to inform the competent committees about its conclusions on this matter;

18. De Partijen ondersteunen de samenwerking op het gebied van openbare administratie die beoogt de bestuurlijke stelsels aan te passen aan de openstelling van hun onderlinge goederen- en dienstenverkeer.
18. The Parties will support cooperation on public administration to promote the adjustment of administrative systems to open trading in goods and services between them.
