4. wijst erop dat de begroting voor 2011 de vierde van zeven begrotingen in het kader van het huidige MFK is, en benadrukt dat punt 37 van het IIA over het gebruik van de 5% marge van de wetgevingsflexibiliteit nu uiterst zinvol is aangezien de twee takken van de begrotingsautoriteit een duidelijker beeld hebben van de tekortkomingen van de bestaande programma's, en van de positieve ontwikkelingen ervan; herinnert eraan dat de EU-begroting, ongeacht de bepalingen van het IIA, alleen door te zorgen voor een zekere mate van flexibiliteit op een doelmatige en zinvolle wijze kan worden uitgevoerd; verwacht dat de MFK-verordening van de Raad, die zou moeten worden aangenomen op basis van COM(2010)0072 def., en het toekomstige IIA, dat zou moeten worden aangenomen op basis van COM(2010)0073 def., meer flexibiliteit mogelijk zullen maken;

Points out that the 2011 budget is the fourth of seven under the current MFF, and emphasises that point 37 of the IIA on the use of the 5% margin of legislative flexibility now makes full sense, since the two arms of the budgetary authority have a clearer view of the shortfalls of, and positive developments in, existing programmes; recalls that, irrespective of the provisions of the IIA, ensuring an appropriate level of flexibility in the EU budget is a prerequisite for its effective implementation in a useful manner; expects the Council MFF regulation to be adopted on the basis of COM(2010)0072 final and the forthcoming IIA to be adopted on the basis of COM(2010)0073 final, to allow for greater flexibility;

Recalls that, in accordance with Article 53b of the Financial Regulation and Point 44 of the IIA of 17 May 2006, which aim at ensuring effective and integrated internal control of Community funds and national management declarations as a final goal, the Member States have committed themselves to "produce an annual summary at the appropriate national level of the available audits and declarations"; notes that, according to information received from the Commission, only a limited number of Member States have complied with the provisions of the IIA so far; regrets that none of the concrete proposals on national (management) declarations put forward by the European Parliament in its 2003, 2004 and 2005 discharge resolutions are incorporated in the Commission's Audit Strategy and requests the Commission to keep the Parliament informed; reminds the Member States of their obligation to comply with the provisions of the revised Financial Regulation, to which they only recently agreed; reiterates that Member States are further obliged to fulfil the conditions set out in Point 44 of the IIA as well as being obliged under Article 274 TEC to cooperate fully with the Commission according to the principles of sound financial management;

5. Reiterates that deficits and leftovers are still unresolved from the outcome of the negotiations of the IIA of 17 May 2006 and that these deficits should be addressed in the 2008-2009 mid-term review, as provided for in Declaration 3 of the IIA of 17 May 2006, as well as in the course of the annual budgetary procedures, if possible through more flexibility and in any case by all means foreseen by the IIA of 17 May 2006; recalls, as stated by Parliament in its unilateral declaration during Trilogue on 2 April 2009, that the Commission should take on board during the mid-term review process the principles laid down in its resolution adopted on 25 March 2009;
