A. overwegende dat in zijn jaarlijks activiteitenverslag 2014, het Comité van toezicht van OLAF heeft vastgesteld dat ten tijde van de reorganisatie van OLAF (1 februari 2012), op dezelfde dag 423 onderzoeken zijn geopend op grond van een enkel besluit van de directeur-generaal van OLAF (hierna "de DG van OLAF" genoemd); overwegende dat het Comité op grond van zijn analyse heeft geconcludeerd dat (i) OLAF voor geen enkele van de door het Comité geanalyseerde onderzoeken een passende beoordeling van de ontvangen informatie heeft uitgevoerd, (ii) voor het overgrote deel van de onderzoeken er zelfs geen spoor te bekennen was van enige beoordelingsactiviteit, en (iii) de DG van OLAF de betreffende onderzoeken heeft geopend zonder vooraf vast te stellen dat er een voldoende ernstige verdenking bestond van fraude, corruptie of enige andere onwettige activiteit waardoor de financiële belangen van de Unie worden geschaad, hetgeen in strijd is met de op dat moment geldende wettelijke voorwaarde voor het starten van een onderzoek door OLAF;
A. whereas in its Annual Activity Report 2014 the OLAF Supervisory Committee (SC) noted that at the time of the reorganisation of OLAF (1 February 2012), 423 cases were opened on the same day by a single decision of the Director-General of OLAF (OLAF DG); whereas, on the basis of its analysis, the SC concluded that (i) OLAF did not conduct any appropriate assessment of the incoming information for any of the cases analysed by the SC, (ii) for the vast majority of cases there was not even a trace of any assessment activity, and (iii) the OLAF DG opened all the cases in question without establishing beforehand the existence of a sufficiently serious suspicion that there had been fraud, corruption or any other illegal activity affecting the financial interests of the Union – which is in contradiction with the legal requirement for opening an OLAF investigation in force at that time;

66. wijst eens te meer op de noodzaak om de onafhankelijkheid, doeltreffendheid en doelmatigheid van het OLAF verder te versterken, en is van oordeel dat dit ook geldt voor de onafhankelijkheid van het comité van toezicht van OLAF en het vermogen van dit comité om zijn taken uit te voeren; verzoekt OLAF en het comité van toezicht stappen te ondernemen ter verbetering van de onderlinge werkrelatie, die volgens een verslag van de Commissie EU-zaken van het Britse Hogerhuis gekenmerkt wordt door open vijandigheid, met name omdat de betrokkenen het er niet over eens zijn welke rol het comité van toezicht precies moet spelen; verzoekt de Commissie na te gaan op welke wijze een constructieve bijdrage kan worden geleverd aan het verbeteren van de communicatie en de werkrelatie tussen OLAF en het comité van toezicht;
66. Reiterates that it is necessary to continue to strengthen the independence, effectiveness and efficiency of OLAF, including the independence and functioning of the OLAF Supervisory Committee; calls on OLAF and the Supervisory Committee to take steps with a view to improving their working relationship, which has been described in a report by the UK House of Lords’ EU Committee as one of open hostility, particularly due to the lack of agreement between those concerned over the precise nature of the Supervisory Committee’s role; calls on the Commission to explore ways to deliver a constructive contribution in respect of improving communication and working relations between OLAF and its Supervisory Committee;
