Onverminderd maatregelen of acties die moeten worden ondernomen overeenkomstig artikel 30 van Verordening (EG) nr. 834/2007, geldt dat wanneer een controlerende autoriteit of een controleorganen van een lidstaat of een derde land een gegrond vermoeden heeft dat inbreuken of onregelmatigheden zijn begaan op het gebied van de overeenstemming van geïmporteerde biologische producten uit overeenkomstig artikel 33, lid 2, van Verordening (EG) nr. 834/2007 erkende derde landen of geïmporteerde biologische producten die worden gecontroleerd door overeenkomstig artikel 33, lid 3, van die verordening erkende controlerende autoriteiten of controleorganen, met de in die verordening vastgestelde voorschriften, die controlerende autoriteit of dat controleorganen alle nodige, in artikel 91, lid 2, van Verordening (EG) nr. 889/2008 bedoelde maatregelen neemt en dit onverwijld meldt aan de controleorganen, controlerende autoriteiten en bevoegde autoriteiten van de betrokken lidstaten en van de bij de biologische productie van de producten betrokken derde landen, alsmede aan de Commissie”.
Without prejudice to any measures or actions to be taken in accordance with Article 30 of Regulation (EC) No 834/2007, where a control authority or control body of a Member State or a third country has a substantiated suspicion of an infringement or irregularity as regards compliance of imported organic products from third countries recognised in accordance with Article 33(2) of Regulation (EC) No 834/2007 or imported organic products controlled by control authorities or control bodies recognised in accordance with Article 33(3) of that Regulation with the requirements laid down in that Regulation, it shall take all necessary measures in accordance with Article 91(2) of Regulation (EC) No 889/2008 and shall immediately inform the control bodies, control authorities and competent authorities of the Member States concerned and of the third countries involved in the organic production of the products in question and the Commission’.

In het licht van de ervaring die is opgedaan met het toezicht op het gelijkwaardigheidssysteem en gelet op punt 5.1.4 van de mededeling van de Commissie „EU-richtsnoeren betreffende de beste praktijken voor vrijwillige certificeringsregelingen voor landbouwproducten en levensmiddelen” (3), waarin wordt aanbevolen dat de specificaties van de regeling, met inbegrip van een openbare samenvatting, gratis beschikbaar worden gesteld, bijvoorbeeld op een website, en gelet op het feit dat verscheidene in bijlage IV bij Verordening (EG) nr. 1235/2008 opgenomen controleorganen en controleautoriteiten hun biologische normen op hun website bekendmaken, is het passend voor te schrijven dat overeenkomstig artikel 33, lid 3, van Verordening (EG) nr. 834/2007 erkende controleorganen en controlerende autoriteiten de biologische normen en controlemaatregelen waarvoor zij zijn erkend, op hun website moeten bekendmaken, alsmede in de inhoud van de lijst van erkende controleorganen en controlerende autoriteiten de internetwebsite te vermelden waar die informatie kan worden gevonden.
In the light of the experience gained with the supervision of the equivalence system and in view of point 5.1.4 of the Commission Communication entitled EU best practice guidelines for voluntary certification schemes for agricultural products and foodstuffs (3), which recommends that scheme specifications, including a public summary, be made freely available, for example on a website, and in view of the fact that several control bodies and control authorities listed in Annex IV to Regulation (EC) No 1235/2008 publish their organic standard on their websites, it is appropriate to require control bodies and control authorities recognised in accordance with Article 33(3) of Regulation (EC) No 834/2007 to publish the production standard and control measures for which they have been recognised on their website and to include the internet website where that information can be found in the content of the list of recognised control bodies and control authorities.

2. Indien een marktdeelnemer die onderworpen is aan de controles van de in lid 1 bedoelde controlerende autoriteiten en controleorganen, daar binnen een door die controlerende autoriteiten en controleorganen bepaalde termijn om verzoekt, verstrekken de controlerende autoriteiten en controleorganen volgens het in bijlage XII bis opgenomen model een bewijsstuk ter staving van de specifieke kenmerken van de gebruikte productiemethode.
2. If an operator subject to the controls of the control authorities and control bodies as referred to in paragraph 1 so requests within a time period to be indicated by those control authorities and control bodies, the control authorities and control bodies shall provide complementary documentary evidence confirming the specific characteristics of the production method used by means of the model set out in Annex XIIa.

3. 3. For products not imported under Article 32 and not imported from a third country which is recognised under paragraph 2 of this Article, the Commission may, in accordance with the procedure referred to in Article 37(2), recognise the control authorities and control bodies, including control authorities and control bodies as referred to in Article 27, competent to carry out controls and issue certificates in third countries for the purpose of paragraph 1, and establish a list of these control authorities and control bodies.

2. The Commission shall, in accordance with the procedure referred to in Article 37(2), recognise the control authorities and control bodies referred to in paragraph 1(b) of this Article, including control authorities and control bodies as referred to in Article 27, which are competent to carry out controls and to issue the documentary evidence referred to in paragraph 1(c) of this Article in third countries, and establish a list of these control authorities and control bodies.
