In zijn resolutie van 14 januari 2004 over instandhouding en bevordering van de culturele verscheidenheid: de rol van de Europese regio's en internationale organisaties als de UNESCO en de Raad van Europa en in zijn resolutie van 14 april 2005 over het werken naar een Conventie over bescherming van de verscheidenheid van culturele inhoud en artistieke uitdrukking achtte het Europees Parlement het van essentieel belang om culturele verscheidenheid te erkennen binnen het bestek van het internationaal recht door een Conventie van de UNESCO goed te keuren. Agrees with the Commission that a legally binding standard on cultural diversity is necessary in order to consolidate cultural rights, foster the development of public cultural policies in each State, commit Parties to international cooperation, create a forum for debate on cultural policies and establish global monitoring of the state of cultural diversity world-wide, as proposed in its aforementioned resolution of 5 September 2001;

In line with Article 151 (4) of the Treaty, which imposes an obligation on the Community to take cultural aspects into account in its action under other provisions of the Treaty with a view to respecting and promoting cultural diversity [77], the dual objective of promoting cultural diversity and the competitiveness of the European programme industry finds its concrete expression in a series of measures in favour of the distribution and production of European television programmes contained in the "television without frontiers" Directive This mechanism, which is linked to complementary financial support mechanisms such as the Media programme, is based on the provisions contained in Chapter III of the "television without frontiers" Directive: Article 4 (promotion of European works), Article 5 (promotion of European works by independent producers), Article 6 (definition of "European works"), Article 7 (chronology for broadcasting cinematographic works) and Article 9 (exemption of local television broadcasts not forming part of a national network).

(7) De Gemeenschap dient zich bijgevolg in te zetten voor de ontwikkeling, op basis van het subsidiariteitsbeginsel, van een open en veelzijdige, voor alle Europeanen gemeenschappelijke culturele ruimte, de samenwerking tussen alle culturele actoren, de bevordering van een wetgevingskader dat gunstig is voor culturele activiteiten en dat instaat voor de eerbiediging van de culturele verscheidenheid, alsmede voor de integratie van culturele aspecten in het communautair beleid, zoals is bepaald in artikel 151, lid 4, van het Verdrag.
(7) The Community is consequently committed to working towards the development of a cultural area common to the European people, which is open, varied and founded on the principle of subsidiarity, cooperation between all those involved in the cultural sector, the promotion of a legislative framework conducive to cultural activities and ensuring respect for cultural diversity, and the integration of the cultural dimension into Community policies as provided for in Article 151(4) of the Treaty.
