(7) Overwegende dat de goederen vooral moeten overeenstemmen met de overeenkomst; dat overeenstemming met de overeenkomst kan worden beschouwd als een gemeenschappelijk beginsel van de diverse nationale rechtstradities; dat het in bepaalde nationale rechtstradities wellicht niet mogelijk is om op grond van uitsluitend dit beginsel een minimaal beschermingsniveau voor de consument te waarborgen; dat voor dergelijke rechtstradities aanvullende nationale bepalingen van nut kunnen zijn om de bescherming van de consument te waarborgen voor gevallen waarin de partijen in de overeenkomst geen specifieke bedingen hebben opgenomen dan wel bedingen of afspraken die direct of indirect voorzien in afstand of beperking van de rechten van de consument en - voor zover de betrokken rechten voortvloeien uit deze richtlijn -, niet bindend zijn voor de consument;
(7) Whereas the goods must, above all, conform with the contractual specifications; whereas the principle of conformity with the contract may be considered as common to the different national legal traditions; whereas in certain national legal traditions it may not be possible to rely solely on this principle to ensure a minimum level of protection for the consumer; whereas under such legal traditions, in particular, additional national provisions may be useful to ensure that the consumer is protected in cases where the parties have agreed no specific contractual terms or where the parties have concluded contractual terms or agreements which directly or indirectly waive or restrict the rights of the consumer and which, to the extent that these rights result from this Directive, are not binding on the consumer;
