over het voorstel voor een verordening van het Europees Parlement en de Raad houdende wijziging van Verordening (EG) nr. 450/2008 tot vaststelling van het communautair douanewetboek (gemoderniseerd douanewetboek) wat de toepassingsdatum betreft
on the proposal for a regulation of the European Parliament and of the Council amending Regulation (EC) No 450/2008 laying down the Community Customs Code (Modernised Customs Code) as regards the date of its application

32. betreurt het uitstel van de inwerkingtreding van het gemoderniseerde douanewetboek zoals gepland in het voorstel van de Commissie voor een verordening van het Europees Parlement en de Raad tot vaststelling van het douanewetboek van de Unie (COM(2012)0064), en is van mening dat de voorgestelde nieuwe datum, namelijk 31 december 2020, onaanvaardbaar is; herinnert eraan dat Verordening (EG) nr. 450/2008 van het Europees Parlement en de Raad van 23 april 2008 tot vaststelling van het communautair douanewetboek (gemoderniseerd douanewetboek) erin voorzag dat het communautair douanewetboek uiterlijk op 24 juni 2013 in werking zou treden, en verzoekt de Commissie en de lidstaten met klem de nodige stappen te ondernemen om het voorbereidingsproces te bespoedigen;
32. Deplores the postponement of the entry into force of the Modernised Customs Code (MCC) as provided for in the Commission's proposal for a regulation of the European Parliament and of the Council laying down the Union Customs Code (COM(2012)0064), and considers the proposed new date of 31 December 2020 to be unacceptable; recalls that Regulation (EC) No 450/2008 of the European Parliament and of the Council of 23 April 2008 laying down the Community Customs Code (Modernised Customs Code) provided that the MCC would enter into force by 24 June 2013 and urges the Commission and Member States to take the necessary steps in order to speed up the preparation process;

111. wijst op een in opdracht van het Parlement uitgevoerde studie over de „Uitvoering van het gemoderniseerd douanewetboek” , waaruit blijkt dat het gemoderniseerd douanewetboek (dat het douanewetboek van de Unie zal heten indien het herschikkingsvoorstel van de Commissie wordt aangenomen) in het beste geval in werking treedt in december 2017; herinnert de Commissie eraan dat de EU exclusief bevoegd is op het gebied van de douane-unie en daarom moet toezien op de naleving door de lidstaten; roept de Commissie derhalve op meer inspanningen te leveren om ervoor te zorgen dat het gemoderniseerd douanewetboek zo snel mogelijk ten uitvoer wordt gelegd, en om in elk geval het in de studie genoemde slechtst denkbare scenario van maart 2033 te voorkomen;

Points to a study commissioned by Parliament on the ‘Implementation of the Modernised Customs Code’ , from which it results that, in the best-case scenario, the entry into force of the MCC (which will be called the Union's Customs Code if the recast proposal by the Commission is adopted) could take place in December 2017; reminds the Commission that the Union has exclusive competence in the area of the customs union and that it should, therefore, ensure compliance by the Member States; calls on the Commission, as a consequence, to step up its efforts to ensure that the MCC is implemented at the earliest possible date, and in any event to avoid the worst-case scenario indicated in the study for March 2033;

Regulation (EC) No 450/2008 of the European Parliament and of the Council of 23 April 2008 laying down the Community Customs Code (Modernised Customs Code) (3) is intended to replace Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code (4).

Artikel 36 bis van Verordening (EEG) nr. 2913/92 van de Raad van 12 oktober 1992 tot vaststelling van het communautair douanewetboek (PB L 302 van 19.10.1992, blz. 1) en artikel 87 van Verordening (EG) nr. 450/2008 van het Europees Parlement en de Raad van 23 april 2008 tot vaststelling van het communautair douanewetboek (gemoderniseerd douanewetboek) (PB L 145 van 4.6.2008, blz. 1).

Gelet op de toegenomen veiligheidsgerelateerde maatregelen die bij Verordening (EG) nr. 648/2005 van het Europees Parlement en de Raad van 13 april 2005 houdende wijziging van Verordening (EEG) nr. 2913/92 van de Raad tot vaststelling van het communautair douanewetboek (6) in het wetboek zijn opgenomen, dient de plaatsing van goederen in een vrije zone een douaneregeling te worden en dienen het binnenbrengen en de administratie van deze goederen aan douanecontroles te worden onderworpen.
In view of the increased security-related measures introduced into the Code under Regulation (EC) No 648/2005 of the European Parliament and of the Council of 13 April 2005 amending Council Regulation (EEC) No 2913/92 establishing the Community Customs Code (6), the placing of goods into free zones should become a customs procedure and the goods should be subject to customs controls at entry and with regard to records.
