Besluit C(2010) 7694 definitief van de Commissie van 9 november 2010 betreffende een procedure op grond van artikel 101 VWEU, artikel 53 van de EER-Overeenkomst en artikel 8 van de Overeenkomst tussen de Europese Gemeenschap en de Zwitserse Bondsstaat inzake luchtvervoer (zaak COMP/39258 — Luchtvracht) wordt nietig verklaard voor zover de Europese Commissie hierin, in de eerste plaats, op het standpunt stond dat British Airways plc, ten eerste, had deelgenomen aan de weigering om commissie te betalen, ten tweede, tussen 22 januari 2001 en 1 oktober 2001 inbreuk had gemaakt op artikel 101 VWEU, op artikel 53 van de Overeenkomst betreffende de Europese Economische Ruimte (EER) en op artikel 8 van de Overeenkomst tussen de Europese Gemeenschap en de Zwitserse Bondsstaat inzake luchtvervoer en, ten derde, had deelgenomen aan inbreuken op deze bepalingen voor vrachtdiensten vanuit Hong Kong (China), Japan, India, Thailand, Singapore, Zuid-Korea en Brazilië, en, in de tweede plaats, haar een geldboete heeft opgelegd.
Annuls Commission Decision C(2010) 7694 final of 9 November 2010 relating to a proceeding under Article 101 TFEU, Article 53 of the EEA Agreement and Article 8 of the Agreement between the European Community and the Swiss Confederation on Air Transport (Case COMP/39258 — Airfreight), in so far as, in that decision, the European Commission, first, considered that British Airways plc (i) participated in the refusal to pay commission, (ii) infringed Article 101 TFEU, Article 53 of the Agreement on the European Economic Area (EEA) and Article 8 of the Agreement between the European Community and the Swiss Confederation on Air Transport between 22 January 2001 and 1 October 2001, and (iii) participated in infringements of those provisions for freight services performed from Hong Kong (China), Japan, India, Thailand, Singapore, South Korea and Brazil, and, secondly, imposed a fine on it;

In zijn resolutie van 7 juli 2010 met aanbevelingen aan de Commissie betreffende grensoverschrijdende crisisbeheersing in de bankensector verzocht het Europees Parlement „de Commissie om uit hoofde van de artikelen 50 en 114 van het Verdrag betreffende de werking van de Europese Unie één of meer wetgevingsvoorstellen in te dienen inzake een EU-kader voor crisisbeheer, een financieel stabiliteitsfonds van de EU en een Eenheid afwikkeling”, en in zijn resolutie van 20 november 2012 met aanbevelingen aan de Commissie inzake het verslag van de voorzitters van de Europese Raad, de Europese Commissie, de Europese Centrale Bank en de Eurogroep met als titel „Naar een echte economische en monetaire unie” verklaarde het Parlement dat „het doorbreken van de negatieve terugkoppelingseffecten tussen overheden, banken en de reële economie cruciaal is voor het soepel functioneren van de EMU”, betoogde het dat „er dringend behoefte is aan aanvullende en verstrekkende maatregelen om de crisis in de bankensector op te lossen” en „om een volledig operationele Europese bankenunie te kunnen realiseren” en tegelijkertijd „de voortdurende goede werking van de interne markt voor financiële diensten en het vrije verkeer van kapitaal te kunnen zeker te stellen”.
The European Parliament, in its resolution of 7 July 2010 with recommendations to the Commission on Cross-Border Crisis Management in the Banking Sector, requested the Commission to submit ‘on the basis of Articles 50 and 114 of the Treaty on the Functioning of the European Union, one or more legislative proposals relating to an EU crisis-management framework, an EU financial stability fund, and a resolution unit’ and, in its resolution of 20 November 2012 with recommendations to the Commission on the report of the Presidents of the European Council, the European Commission, the European Central Bank and the Eurogroup ‘Towards a genuine Economic and Monetary Union’, stated that ‘breaking up the negative feedback loops between sovereigns, banks and the real economy is crucial for a smooth functioning of the EMU’, stressed the ‘urgent need for additional and far-reaching measures to solve the crisis in the banking sector’ and for the ‘realisation of a fully operational European banking union’ while ensuring ‘the continued proper functioning of the internal market for financial services and the free movement of capital’.

The establishment and operation of the register shall build upon the existing registration systems set up and launched by the European Parliament in 1996 and the European Commission in June 2008, supplemented by the work of the relevant European Parliament and European Commission joint working group as well as by the adaptations made in the light of the experience gained and the input collected from stakeholders as set out in the European Commission’s Communication of 28 October 2009 entitled ‘European Transparency Initiative: the Register of Interest Representatives, one year after’ (1).

On 10 October 2008, the European Central Bank (ECB) received a request from the European Commission services for an opinion on a draft Commission decision establishing the Committee of European Banking Supervisors (hereinafter the ‘draft decision’).

De ECB ondersteunt het streven naar consistentere besluiten van de Europese Commissie tot oprichting van de „Lamfalussy”-Comités van Toezichthouders (Niveau-3 Comités), d.w.z. het CEBS, het Comité van Europese toezichthouders op verzekeringen en bedrijfspensioenen (CEIOPS) en het Comité van Europese Effectenregelgevers (CEER) (8). De Commissie zou desgevallend kunnen rekening houden met de specifieke opmerkingen in dit advies aangaande de ontwerp-besluiten inzake de twee andere Niveau-3 Comités waaromtrent de ECB niet geconsulteerd werd.
The ECB supports the objective of greater consistency between the Commission decisions which established the ‘Lamfalussy’ Committees of Supervisors (Level 3 Committees), i.e. CEBS, the Committee of European Insurance and Occupational Pensions Supervisors (CEIOPS) and the Committee of European Securities Regulators (CESR) (8) and where applicable the Commission may also choose to take into account the specific comments in this opinion in relation to the draft decisions pertaining to the other two Level 3 Committees, on which the ECB is not consulted.
