Op basis van de beschikbare documentatie en van de opmerkingen van de betrokken partijen is de Commissie van mening dat de fluorescentielamp, merk en type „GW 80 455”, in de configuratie zoals die door de Zweedse autoriteiten is geanalyseerd aan de hand van de geharmoniseerde norm EN 60079-0:2006, niet voldoet aan de essentiële veiligheids- en gezondheidseisen bedoeld in artikel 3 van Richtlijn 94/9/EG en bijlage II daarbij, met name in de punten 1.0.5 (Merktekens) en 1.0.6 (Gebruiksaanwijzing).
In light of the documentation available, and the comments of the parties concerned, the Commission considers that the fluorescent lamp, mark and type ‘GW 80 455’, in its configuration as analysed by the Swedish authorities making reference to the harmonised standard EN 60079-0:2006, failed to comply with the essential health and safety requirements referred to in Article 3 of the Directive 94/9/EC and set out in Annex II, in particular in points 1.0.5 (Marking) and 1.0.6 (Instructions).
