(2) Er dienen openbare inschrijvingen voor de verkoop van alcohol uit wijnbouwproducten voor nieuwe vormen van industrieel gebruik te worden gehouden om de voorraden communautaire alcohol uit wijnbouwproducten te verkleinen en om het mogelijk te maken dat in de Gemeenschap kleinschalige industriële projecten worden uitgevoerd of dat alcohol wordt verwerkt tot goederen die bestemd zijn voor uitvoer voor industriële doeleinden.

Bovendien moet worden bepaald dat bij verkoop in het kader van bepaalde openbare inschrijvingen de alcohol in voorkomend geval wordt gedenatureerd om te voorkomen dat hij voor andere doeleinden wordt gebruikt; de denaturering dient te gebeuren door benzine aan de toegewezen alcohol toe te voegen.

De Afdeling komt daarbij tot de volgende bevindingen: - de produktie van alcohol uit landbouwprodukten bedraagt 14 mln hl zuivere alcohol, terwijl de produktie van synthetische alcohol zich op 5,5 mln hl heeft gestabiliseerd; - de produktie van alcohol uit landbouwprodukten is in tien jaar met 25% toegenomen (alleen de produktie van wijnalcohol is de afgelopen jaren minder groot geworden); - de rechtstreekse consumptie van alcohol uit landbouwprodukten loopt steeds meer terug, terwijl de vraag naar alcohol voor industriële doeleinden toeneemt (maar daar is de concurrentie met synthetische alcohol groot); - een gebruiksmogelijkheid voor alcohol uit landbouwprodukten ligt in de produktie van ethanol als brandstof; - in de handel met landen buiten de EU kan worden vastgesteld dat de invoer toeneemt en de uitvoer afneemt.
