In het bijzonder verklaart de Europese Gemeenschap tevens dat de geldende rechtsinstrumenten de uitvoering van de verplichtingen uit hoofde van artikel 9, lid 3, van het Verdrag van Aarhus niet volledig dekken aangezien deze betrekking hebben op bestuursrechtelijke of rechterlijke procedures om handelingen en nalatigheden te betwisten van particulieren en andere overheidsinstanties dan de instellingen van de Europese Gemeenschap, zoals bepaald in artikel 2, lid 2, onder d), van het Verdrag van Aarhus, en dat bijgevolg bij de goedkeuring van het Verdrag van Aarhus door de Europese Gemeenschap haar lidstaten verantwoordelijk zijn voor de uitvoering van deze verplichtingen en dit ook zullen blijven tenzij en totdat de Gemeenschap in de uitoefening van haar bevoegdheden uit hoofde van het EG-Verdrag bepalingen van Gemeenschapsrecht inzake de uitvoering van deze verplichtingen aanneemt.
In particular, the European Community also declares that the legal instruments in force do not cover fully the implementation of the obligations resulting from Article 9(3) of the Convention as they relate to administrative and judicial procedures to challenge acts and omissions by private persons and public authorities other than the institutions of the European Community as covered by Article 2(2)(d) of the Convention, and that, consequently, its Member States are responsible for the performance of these obligations at the time of approval of the Convention by the European Community and will remain so unless and until the Community, in the exercise of its powers under the EC Treaty, adopts provisions of Community law covering the implementation of those obligations.

2. Als voor Chileense financiële dienstverleners lidmaatschap van, deelname aan of toegang tot organen voor zelfregulering, effectenbeurzen, termijnmarkten, clearingmaatschappijen of andere organisaties of verenigingen door de Gemeenschap verplicht gesteld is voor het verlenen van financiële diensten op dezelfde basis als financiële dienstverleners van de Gemeenschap, of als de Gemeenschap direct of indirect dergelijke entiteiten, privileges of voordelen biedt bij het verlenen van financiële diensten, zal de Gemeenschap ervoor zorgen dat de betreffende entiteiten nationale behandeling toekennen aan Chileense financiële dienstverleners die binnen de Gemeenschap verblijven.
2. When membership or participation in, or access to, any self-regulatory body, securities or futures exchange or market, clearing agency, or any other organisation or association, is required by the Community in order for financial service suppliers of Chile to supply financial services on an equal basis with financial service suppliers of the the Community, or when the Community provides directly or indirectly such entities, privileges or advantages in supplying financial services, the Community shall ensure that such entities accord national treatment to Chilean financial service suppliers resident in its territory.
