This [INSTRUMENT] constitutes a development of the provisions of the Schengen acquis in which the United Kingdom does not take part, in accordance with Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis*; the United Kingdom is therefore not taking part in its adoption and is not bound by it or subject to its application.

Voor zover zij betrekking heeft op onderdanen van derde landen die niet of niet langer voldoen aan de toegangsvoorwaarden volgens de Schengengrenscode, vormt deze richtlijn een ontwikkeling van bepalingen van het Schengenacquis waaraan het Verenigd Koninkrijk overeenkomstig Besluit 2000/365/EG van de Raad van 29 mei 2000 betreffende het verzoek van het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland deel te mogen nemen aan enkele van de bepalingen van het Schengenacquis niet deelneemt; daarnaast neemt het Verenigd Koninkrijk, overeenkomstig de artikelen 1 en 2 van het Protocol betreffende de positie van het Verenigd Koninkrijk en Ierland, gehecht aan het Verdrag betreffende de Europese Unie en het Verdrag tot oprichting van de Europese Gemeenschap, en onverminderd artikel 4 van genoemd protocol, niet deel aan de aanneming van deze richtlijn en is deze bijgevolg niet bindend voor, noch van toepassing in het Verenigd Koninkrijk.
To the extent that it applies to third-country nationals who do not fulfil or who no longer fulfil the conditions of entry in accordance with the Schengen Borders Code, this Directive constitutes a development of provisions of the Schengen acquis in which the United Kingdom does not take part, in accordance with Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis ; moreover, in accordance with Articles 1 and 2 of the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, and without prejudice to Article 4 of the said Protocol, the United Kingdom is not taking part in the adoption of this Directive and is therefore not bound by it in its entirety or subject to its application.

Het Verenigd Koninkrijk neemt aan deze beschikking deel overeenkomstig artikel 5 van het Protocol tot opneming van het Schengenacquis in het kader van de Europese Unie en artikel 8, lid 2, van Besluit 2000/365/EG van de Raad van 29 mei 2000 betreffende het verzoek van het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland deel te mogen nemen aan enkele bepalingen van het Schengenacquis , voorzover de maatregelen daarvan een ontwikkeling vormen van bepalingen van het Schengenacquis ter bestrijding van de organisatie van illegale immigratie waaraan het Verenigd Koninkrijk deelneemt, en artikel 3 van het Protocol betreffende de positie van het Verenigd Koninkrijk en Ierland, dat aan het Verdrag betreffende de Europese Unie en het Verdrag tot oprichting van de Europese Gemeenschap is gehecht, aangezien het Verenigd Koninkrijk schriftelijk kenbaar heeft gemaakt dat het wenst deel te nemen aan de aanneming en de toepassing van deze beschikking.
The United Kingdom is taking part in this Decision, in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and to the Treaty establishing the European Community and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis , to the extent that its measures develop provisions of the Schengen acquis against the organisation of illegal immigration in which the United Kingdom participates, and the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, having notified under Article 3 thereof its wish to take part in the adoption and application of this Decision.
