Underlines the role of the parliament as a key democratic institution and calls therefore for a strengthening of its oversight role and for ensuring a more institutionalised consultation process on draft legislation; welcomes in this regard the consensual parliamentary resolution of 24 December 2014 in which it was agreed that the opposition would return to parliamentary work while the governing majority would seek consensus with the opposition on important reforms, that the decisions of the Constitutional Court (CC) would be respected and the issue of people with criminal records holding or running for public office addressed; calls for its proper and timely implementation in a constructive manner; calls on all political parties to improve democratic consensus-building, which is the key to advancing in the accession process; considers it important that Albania’s civil society, media and citizens hold their leaders accountable for specific policy outcomes;

As regards the offences of passive corruption and misappropriation, there is a need to include a definition of public officials covering all relevant officials, whether appointed, elected or employed on the basis of a contract, holding a formal office, as well as persons exercising the function of providing service from government and other public bodies to citizens, or for the public interest in general, without holding a formal office, such as contractors involved in the management of EU funds.

Indien de in lid 4 bedoelde autoriteiten of instanties in een lidstaat bij de uitoefening van hun opsporings- of onderzoektaken een beroep doen op personen die op grond van hun specifieke deskundigheid met een opdracht worden belast en die geen openbaar ambt bekleden, kan de in dat lid bedoelde mogelijkheid tot uitwisseling van informatie tot deze personen worden verruimd op de in lid 5 genoemde voorwaarden.

Where, in a Member State, the authorities or bodies referred to in paragraph 4 perform their task of detection or investigation with the aid, in view of their specific competence, of persons appointed for that purpose and not employed in the public sector the possibility of exchanging information provided for in that paragraph may be extended to such persons under the conditions stipulated in paragraph 5.
