(2) Voor zover deze geneesmiddelen voor geavanceerde therapie worden aangeduid als middelen die therapeutische of profylactische eigenschappen met betrekking tot ziektes bij de mens hebben of die bij de mens kunnen worden gebruikt of aan de mens kunnen worden toegediend om fysiologische functies te herstellen, te verbeteren of te wijzigen door een farmacologisch, immunologisch of metabolisch effect te bewerkstelligen, zijn het biologische geneesmiddelen in de zin van artikel 1, punt 2, en bijlage I van Richtlijn 2001/83/EG van het Europees Parlement en de Raad van 6 november 2001 tot vaststelling van een communautair wetboek betreffende geneesmiddelen voor menselijk gebruik.
(2) Insofar as these advanced therapy products are presented as having properties for treating or preventing diseases in human beings, or that they may be used in or administered to human beings with a view to restoring, correcting or modifying physiological functions by exerting a pharmacological, immunological or metabolic action, they are biological medicinal products within the meaning of Article 1(2) and Annex I to Directive 2001/83/EC of the European Parliament and of the Council of 6 November 2001 on the Community code relating to medicinal products for human use.
