Lastly, the Court finds that the concept of ‘public works contract’ contained in Directive 2004/18 applies in the present case where the legislation makes the grant of a building or land subdivision authorisation subject to a social obligation entailing the development of social housing units which are subsequently to be sold at capped prices to a public institution, or with substitution by it, and where the criteria set out in that provision have been met, a matter which falls to be determined by the referring court.

Ten slotte wenst het Grondwettelijk Hof te vernemen of het begrip „overheidsopdracht voor werken” in richtlijn 2004/18 in casu van toepassing is op de regeling die de toekenning van een bouw- of verkavelingsvergunning afhankelijk stelt van een sociale last die erin bestaat sociale woningen te realiseren die vervolgens tegen geplafonneerde prijzen dienen te worden verkocht aan of met indeplaatsstelling door een openbare instelling. De advocaat-generaal is van mening dat deze richtlijn van toepassing is op een dergelijke regeling, op voorwaarde, ten eerste, dat volgens deze regeling een overeenkomst moet zijn gesloten tussen een aanbestedende dienst en een marktdeelnemer, en, ten tweede, dat de marktdeelnemer werkelijk de mogelijkheid heeft om met de aanbestedende dienst te onderhandelen over de inhoud van die overeenkomst en de prijs die voor de uitgevoerde werken moet worden toegepast.
Finally, the Constitutional Court asks whether the concept of ‘public works contract’ contained in Directive 2004/18 applies in this case, namely to rules which make the granting of a building or land subdivision authorisation subject to a social obligation entailing the development of social housing units which should subsequently be sold at capped prices to, or, with substitution, by, a public institution. The Advocate General considers that the directive applies to such rules, provided that, firstly, they provide for the existence of a contract concluded between a contracting authority and that, secondly, an economic operator has a real opportunity to negotiate with the contracting authority the content of that contract and the price to be applied to the works carried out.
