TRADUCTIONS EN CONTEXTE

Met de modernisering van verordening 1408/71 [9] wordt deze dimensie opgenomen, en de toepassing daarvan wordt uiteengezet in een op 13 januari 2004 ingediend voorstel voor een richtlijn betreffende diensten op de interne markt, waarin een definitie van intramurale zorg is opgenomen [10].
The updated version of Regulation 1408/71 [9] includes this dimension, and its application is specified in a proposal for a directive presented on 13 January 2004 on services in the internal market, which includes a definition of hospital services [10].

„Intramurale zorg”: de in een zorginstelling geleverde behandeling en/of verzorging aan patiënten die officieel zijn opgenomen en die overnachting nodig hebben.
‘Inpatient care’ means the treatment and/or care provided in a healthcare facility to patients formally admitted and requiring an overnight stay.

„Ziekenhuizen”: de erkende inrichtingen die zich in de eerste plaats bezighouden met het verlenen van medische, diagnostische en therapeutische diensten, waaronder zorg door artsen en verpleegkundigen en andere gezondheidsdiensten aan intramurale patiënten en gespecialiseerde accommodatie voor intramurale patiënten, maar die eventueel ook ambulante en extramurale zorg en thuiszorg verlenen.
‘Hospitals’ means the licensed establishments that are primarily engaged in providing medical, diagnostic and treatment services that include physician, nursing and other health services to inpatients and the specialised accommodation services required by inpatients and which may also provide day care, outpatient and home healthcare services.

According to the constant case-law of the Court of Justice, Member States may make the assumption of costs by the national system of hospital care provided in another Member State subject to prior authorisation.

This Directive should provide for a system of prior authorisation for assumption of costs for hospital care received in another Member State, where the following conditions are met : had the treatment been provided on its territory, it would have been assumed by its social security system and the consequent outflow of patients due to the implementation of the directive seriously undermines or is likely to seriously undermine the financial balance of the social security system and/or that outflow of patients seriously undermines, or is likely to seriously undermine, the planning and rationalisation carried out in the hospital sector to avoid hospital overcapacity, imbalance in the supply of hospital care and logistical and financial wastage, the maintenance of a balanced medical and hospital service open to all, or the maintenance of treatment capacity or medical competence on the territory of the Member State concerned.
