A. overwegende dat de herziening van Richtlijn 2001/29/EG essentieel is voor de bevordering van creativiteit en innovatie, culturele diversiteit, economische groei, concurrentievermogen, de digitale eengemaakte markt en toegang tot kennis en informatie, terwijl deze tegelijkertijd aan de auteurs van werken van letterkunde en kunst voldoende erkenning en bescherming van hun rechten verstrekt;
A. whereas the revision of Directive 2001/29/EC is central to the promotion of creativity and innovation, cultural diversity, economic growth, competitiveness, the Digital Single Market and to access to knowledge and information, while at the same time also providing authors of literary and artistic works with sufficient recognition and protection of their rights;

D. overwegende dat in Richtlijn 2001/29/EG eveneens een aantal verplichtingen van de EU overeenkomstig internationaal recht worden behandeld, waaronder de bepalingen van de Berner Conventie voor de bescherming van werken van letterkunde en kunst, het Verdrag van de WIPO inzake het auteursrecht en het Verdrag van de WIPO inzake uitvoeringen en fonogrammen;
D. whereas Directive 2001/29/EC also addresses a number of EU obligations under international law, including the provisions of the Berne Convention for the Protection of Literary and Artistic Works, the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty;

(7a) Taking into account the legislation of the Union and the Member States and the Union's international obligations, notably under the Berne Convention for the Protection of Literary and Artistic Works and the Agreement on Trade-Related Aspects of Intellectual Property Rights (the TRIPS Agreement), documents on which third parties hold intellectual property rights should be excluded from the scope of Directive 2003/98/EC.
