5. 2. 2. When giving their notification under paragraph 1 the Contracting Parties shall make any of the notifications or declarations provided for in Articles 5(2), 9(3), 28(2) and 34(2) of this Agreement and may make any of the notifications or declarations provided for in Articles 3(4), 6(2), 7(2), 10(1), 11(2), 16(4), 20(5), 30(1), 31(1) and 35(2) of this Agreement.

Paragraph 2 of this article provides that upon request of an interested party, the minister for agriculture may issue a decision concerning the establishment of a zone for growing GMOs after consultation with the minister for environment and the council of the district authority (gmina) in the territory of which the GMOs are intended to be grown.

5. Wanneer de Commissie van een Lid-Staat een kennisgeving overeenkomstig lid 1 van dit artikel ontvangt, deelt zij de Lid-Staat mee of het, volgens haar, gezien de bijzondere situatie van de betrokken Lid-Staat, op basis van de criteria van de in de leden 2 en 3 aangehaalde criteria gerechtvaardigd is de toepassing van artikel 7, lid 1 of lid 2, of artikel 10, lid 1 of lid 2, voor deze Lid-Staat uit te stellen en deelt zij mede tot wanneer dat uitstel gerechtvaardigd is.
5. When the Commission receives a notification in accordance with paragraph 1, it shall inform the Member State whether it deems that the particular situation of the Member State concerned justifies, on the basis of criteria set out in paragraphs 2 and 3, a deferment for this Member State of the application of Article 7 (1) or (2) of Article 10 (1) or (2) and until which date such deferment is justified.
