In haar tweede rulingaanvraag wees McDonald's op dit probleem en drong zij er op aan dat Luxemburg de winst die in de VS niet werd belast toch in Luxemburg van belasting zou vrijstellen.
McDonald's clarified this in a submission requesting a second ruling, insisting that Luxembourg should nevertheless exempt the profits not taxed in the US from taxation in Luxembourg.

De Commissie is een diepgaand staatssteunonderzoek gestart naar de fiscale behandeling van McDonald's in Luxemburg.
