Although we already have current international regulations to minimise this situation – the Marpol 73/78 convention – we are increasingly seeing glaring shortcomings as regards application and compliance; it has also been observed that the civil liability systems governing ship-source pollution in force at present are not sufficiently dissuasive.

It also extends those sanctions to persons - those engaged in transport operations using unsuitable vessels and liable for any resulting pollution damage - who have hitherto been exempted, under international conventions, from third-party liability, and it enables the Member States to implement the Marpol 73/80 International Convention more effectively.

The Community is seriously concerned about the pollution of the seas and coastlines of the Member States caused by discharges of waste and cargo residues from ships, and in particular about the implementation of the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating thereto (Marpol 73/78) which regulates what wastes can be discharged from ships into the marine environment and requires States Parties to ensure the provision of adequate reception facilities in ports. All Member States have ratified Marpol 73/78.
