The Working Group on Pharmaceuticals and Medical Devices which met in Seoul on 11 June 2015 discussed, inter alia, the Korean pharmaceuticals pricing system and the appropriate recognition of the value of innovative drugs and technologies, proposed amendments to the Korean National Health Insurance Act, implementation by Korea of serialisation for drugs, Korea's application for white-listing of Active Pharmaceutical Ingredients (APIs) in the EU, the reimbursement price cuts based on the import price methodology of medical devices, clinical test requirements, and the proposed amendments to the EU medical device legislation related to the CE marking system.

Commends the EU rapid-alert system RAPEX which facilitates the prompt exchange of information between Member States and the Commission on measures taken to prevent or restrict the marketing or use of products posing a serious risk to the health and safety of consumers and professional users or to other public interests protected via the relevant EU legislation (e.g. environment and security), with the exception of food, pharmaceutical and medical devices, which are covered by other mechanisms;

Bearing in mind that not all proprietary medicines are marketed in all Member States, that the same proprietary medicine may be sold with different packaging or content in different Member States, that in some Member States, proprietary medicines may be sold only under a brand name rather than their generic name, and that medicines mentioned in a prescription may be in a language unfamiliar to the doctor or pharmacist providing the healthcare, what is the Commission’s view as to whether a product prescribed in a prescription, but not marketed in a given Member State, can be replaced by another medicinal product (princeps or generic), bearing in mind that this practice is outlawed in some Member States?

5. Deze verordening is niet van toepassing op levensmiddelen, dranken, farmaceutische producten of medische hulpmiddelen zoals bedoeld in Richtlijn 93/42/EEG van de Raad(11), die uitsluitend bestemd zijn voor professioneel gebruik of voor gebruik op recept van of onder toezicht van medisch personeel.
5. This Regulation shall not apply to food, drink, pharmaceuticals nor to medical devices as defined by Council Directive 93/42/EEC(11), which devices are intended only for professional use or to be prescribed or supervised by medical professionals.
