M. whereas a violation of the Union’s common principles and values by a Member State cannot be justified by national traditions nor by the expression of a national identity when such a violation results in the deterioration of the principles which are at the heart of European integration, such as democratic values, the rule of law or the principle of mutual recognition, with the consequence that a referral to Article 4(2) TEU is applicable only in so far as a Member State respects the values enshrined in Article 2 TEU;

(7) The College of Europe, providing postgraduate courses in law, economics, politics, social sciences and humanities with a European dimension, the European University Institute, contributing to the development of European cultural and scientific heritage by means of higher education and research, the European Institute of Public Administration, training national and European civil servants in the field of European integration, the Academy of European Law in Trier, providing university-level training of European law professionals and users, the European Inter-University Centre for Human Rights and Democratisation, providing a European Masters degree and Advanced Internships and other education, training and research services in promotion of human rights and democratisation, the European Agency for Development in Special Needs Education, working to improve the quality of education for pupils with special needs and to foster sustainable European cooperation in this field, and the International Centre for European Training, providing teaching, training and research on issues of Europeanisation, globalisation, federalism, regionalism and the transformation of contemporary social structures, constitute bodies pursuing aims of general European interest.

(4) Overwegende dat de communautaire bepalingen betreffende de vrijheden van de interne markt rechtstreekse werking hebben en volgens de procedures van het nationale recht kunnen worden ingeroepen voor elke nationale rechterlijke instantie; dat de burgers, consumenten en ondernemingen op de toepassing van deze regels moeten kunnen rekenen en de daardoor geboden rechten en garanties moeten kunnen genieten in alle lidstaten; dat hierbij de rechtszekerheid, de geloofwaardigheid van de interne markt en, meer in het algemeen, het vertrouwen in het gehele proces van de Europese eenwording in het geding is;
(4) Whereas those Community rules on the freedoms of the internal market which have direct effect may be invoked before any national court in accordance with procedures defined by national law; whereas citizens, consumers and undertakings must be able to rely on the application of those rules and to benefit from the rights and guarantees which they confer in the Member States as a whole; whereas legal certainty and the credibility of the internal market are at stake as is, more generally, confidence in the whole process of European integration;
