Tsjechië heeft naast Richtlijn 96/92/EG ook Richtlijn 2003/54/EG ten uitvoer gelegd en past de desbetreffende wetgeving toe, waarbij is gekozen voor juridische en organisatorische ontvlechting voor transmissie- en distributienetten, uitgezonderd voor de kleinste distributieondernemingen, die wel onderworpen blijven aan boekhoudkundige ontvlechting, maar zijn vrijgesteld van de vereisten inzake juridische en organisatorische ontvlechting als zij minder dan 100 000 afnemers hebben of het verbruik op hun elektriciteitsnet in 1996 minder dan 3 TWh bedroeg.
The Czech Republic has implemented and applied not only Directive 96/92/EC but also Directive 2003/54/EC, opting for legal and organisational unbundling for transmission and distribution networks except for the smallest distribution companies, which, while continuing to be subject to accounting unbundling, are exempted from the requirements of legal and organisational unbundling having less than 100 000 customers or serving electricity systems with consumption lower than 3 TWh in 1996.

Indien een lidstaat evenwel opteert voor effectieve en doeltreffende ontvlechting, maar drie jaar na de datum van omzetting blijkt dat effectieve en doeltreffende ontvlechting onvoldoende is om te komen tot volledige liberalisering, dan zal ontvlechting van de eigendom verplicht worden gesteld voor alle betrokken lidstaten.

Calls on the Commission to present an analysis in which the expected costs of an ownership unbundling for the Member States, the expected effects on investments in the networks as well as the benefits for the internal market and the customer respectively demonstrated; points out that the analysis should also take account of the question whether and if so which problems or costs occur if no unbundling is carried out by the state as well as whether the negative consequences differ between state and private ownership; suggests that, furthermore, the advantages of ownership unbundling relative to the independent regional market operator approach as regards the achievements of objectives should be analysed;

Concluderend moet over de belangrijke kwestie van ontvlechting worden gesteld dat de huidige voorstellen voor daadwerkelijke ontvlechting een noodzakelijke en beslissende stap zijn om te komen tot marktintegratie in de gehele EU. Dit kan uiteindelijk bijdragen tot het ontstaan van supranationale transmissiesysteembeheerders, aangezien de beheerders niet langer worden gehinderd door onderling wantrouwen.
Concluding on the important question of unbundling, the present proposals for effective unbundling are a necessary and decisive step to achieving EU-wide market integration. It may ultimately help to create supra-national transmission system operators as the operators are no longer held back by mutual distrust.
