Teneinde concurrentieverstoring te vermijden overeenkomstig de beginselen die ten grondslag liggen aan artikel 5, lid 6, van Richtlijn 2002/20/EG en artikel 1, lid 2, van Richtlijn 87/372/EEG van de Raad van 25 juni 1987 inzake de voor een gecoördineerde invoering van openbare paneuropese digitale cellulaire mobiele communicatie te land in de Gemeenschap beschikbaar te stellen frequentiebanden (de „GSM-richtlijn”) moeten de lidstaten derhalve een grondige analyse opmaken van de mededingingseffecten, alvorens over te gaan tot nieuwe spectrumallocaties en ex ante of ex post passende regelgevende maatregelen te nemen, bijvoorbeeld om bestaande rechten te wijzigen, de verwerving van spectrum in bepaalde gevallen te verbieden, voorwaarden op te leggen inzake hamsteren en het efficiënt gebruik van spectrum, zoals de in artikel 9, lid 7, van de Richtlijn 2002/21/EG bedoelde voorwaarden, het toegewezen spectrum per exploitant te beperken en te grote concentraties te vermijden.
Member States should therefore conduct a thorough analysis of competition effects prior to new spectrum allocations, as well as taking appropriate ex ante or ex post regulatory measures (such as action to amend existing rights, to prohibit certain acquisitions of spectrum rights, to impose conditions on spectrum hoarding and efficient use such as those referred to in Article 9(7) of the Directive 2002/21/EC, to limit the amount of spectrum for each operator, or to avoid excessive accumulation of spectrum) to avoid distortions of competition in line with the principles underpinning Article 5(6) of Directive 2002/20/EC and Article 1(2) of Council Directive 87/372/EEC of 25 June 1987 on the frequency bands to be reserved for the coordinated introduction of public pan-European cellular digital land-based mobile communications in the Community (the ‘GSM Directive’).

The Council reached a general approach (15194/07) on a draft Directive, repealing Directive 87/372/EEC on the frequency bands to be reserved for the coordinated introduction of public pan-European cellular digital land-based mobile communications in the Community(GSM Directive).
