While legislation at Community level relating to persistent organic pollutants has been put in place, its main deficiencies are that there is an absence of, or incomplete legislation on, prohibition of the production and use of any of the currently listed chemicals, that there is no framework to subject additional persistent organic pollutant substances to prohibitions, restrictions or elimination, nor any framework to prevent the production and use of new substances that exhibit persistent organic pollutant characteristics.

2. Onverminderd Richtlijn 96/59/EG (15) wordt afval dat geheel of gedeeltelijk uit een in bijlage IV vermelde stof bestaat of daarmee verontreinigd is, zo spoedig mogelijk en in overeenstemming met bijlage V, deel I, zodanig verwijderd of nuttig toegepast dat ervoor wordt gezorgd dat de persistente organische verontreinigende stoffen daarin worden vernietigd of onomkeerbaar worden omgezet, zodat het resterende afval en de vrijkomende stoffen geen kenmerken van persistente organische verontreinigende stoffen vertonen.
2. Notwithstanding Directive 96/59/EC (15), waste consisting of, containing or contaminated by any substance listed in Annex IV shall be disposed of or recovered, without undue delay and in accordance with Annex V, part 1 in such a way as to ensure that the persistent organic pollutant content is destroyed or irreversibly transformed so that the remaining waste and releases do not exhibit the characteristics of persistent organic pollutants.
