In dit verband is het belangrijk te benadrukken dat het Europees Hof van Justitie in zijn arrest in zaak C-383/13 PPU (G en R)[24] heeft bevestigd dat de in artikel 41, lid 2, van het EU-Handvest bedoelde rechten van de verdediging (het recht te worden gehoord en het recht om inzage te krijgen in het dossier) bij beslissingen op grond van de terugkeerrichtlijn moeten worden geëerbiedigd, ook wanneer die rechten niet uitdrukkelijk zijn vastgelegd in de richtlijn.
