– gezien het advies van het Wetenschappelijk Comité voor nieuwe gezondheidsrisico's (WCNG) inzake de veiligheid van door het bedrijf Poly Implant Prothèse (PIP) vervaardigde siliconenproducten, gepubliceerd op 1 februari 2012 ,
– having regard to the opinion of the Scientific Committee on Emerging and Newly Identified Health Risks (SCENIHR) on ‘the safety of silicone products manufactured by the Poly Implant Prothèse (PIP) Company’ published on 1 February 2012 ,

A. overwegende dat naar aanleiding van de bevindingen van de Franse gezondheidsautoriteiten onderzoek is ingesteld naar het frauduleus gebruik door een Frans bedrijf (Poly Implant Prothèse) van materiaal van slechte kwaliteit (industriële silicone) in plaats van het materiaal dat het in de voor de conformiteitsbeoordeling ingediende documenten had aangegeven (goedgekeurde medische silicone);
A. whereas according to the findings of the French health authorities, a French manufacturer (Poly Implant Prothèse) is under investigation for the fraudulent use of low-quality material (industrial silicone) different from the material indicated in the documents submitted for conformity assessment (approved medical-grade silicone);

Denemarken heeft ook gevraagd om de beroepen prothese/orthesemaker („ortopædimekaniker”) en orthopedisch schoenmaker („ortopædiskomager”) uit bijlage II bij Richtlijn 2005/36/EG te schrappen, omdat deze beroepen in Denemarken niet langer zijn gereglementeerd.

Lastly, Germany has asked that the professions of surgical truss maker (‘Bandagist’) and orthopaedic technician (‘Orthopädiemechaniker’) be merged under the term orthopaedic technician (‘Orthopädietechniker’), in accordance with the Crafts Ordinance (Handwerksordnung in the version published on 24 September 1998 (BGBl. I p. 3074; 2006 I p. 2095), last amended by Article 146 of the Ordinance of 31 October 2006 (BGBl. I p. 2407)).

In order to achieve the optimal level of safety and health protection and to reduce the design related problems to the lowest level, the design dossier of hip, knee and shoulder replacements, including the clinical data used by the manufacturer to support the claimed performance and the subsequent post-marketing design and manufacturing changes should be examined in detail by the notified body before these devices are introduced in general clinical use.

1. 1. An insured person or a member of his/her family who has had a right to a prosthesis, a major appliance or other substantial benefits in kind recognised by the institution of a Member State, before he/she became insured under the legislation applied by the institution of another Member State, shall receive such benefits at the expense of the first institution, even if they are awarded after the said person has already become insured under the legislation applied by the second institution.
