Welcomes the fact that after the former Head of the Legal Service left the Agency in June 2012 to join a US-based law firm having a number of pharmaceutical industry companies as clients as senior counsel, the Executive Director of the Agency launched a review of his work as Head of the Legal Service, Chair of the Joint Committee, Chair of the Disciplinary Committee and as a member of the Advisory Committee on Procurement and Contracts; acknowledges that no evidence of conflicts of interest nor breach of obligations provided in Articles 11 and 11a of the Staff Regulations could be identified; welcomes the fact that in accordance with Article 16 of the Staff Regulations, the Executive Director imposed some restrictions to the activities of the former Head of Legal Service for a period of two years following his leaving the Agency; calls on the Agency to provide the discharge authority with detailed information on those restrictions;

Regrets that the Directorate-General responsible did not ask the ACPC (Advisory Committee on Procurements and Contracts) for its opinion beforehand; considers this to be a serious matter, as the ACPC can function effectively only if, in accordance with the rules, it is consulted in advance; does not understand what value there is in obtaining opinions from the ACPC on agreements that have already been entered into; welcomes the Commission's assurances that this is a one-off case;

- the decision of the Joint Committee to add the Committee for Protection of Individuals with regard to the Processing of Personal data to the list of Protocol 37 is being prepared in order to allow for EEA/EFTA participation in the interests of the good functioning of the agreement; -the EEA Council notes the participation of EEA/EFTA in the committees established in framework of programmes in which they participate like MEDIA II, INFO 2000 and in the area of Education; -the EEA Council notes EEA/EFTA participation in the Advisory Committee on the Internal market is being favourably considered; -the EEA Council also notes that EEA/EFTA participation as observers to the Commission's Advisory Committee to Cancer Prevention has been agreed; -noted the ongoing negotiations between the EEA/EFTA States and Canada, Australia and New Zealand of parallel Mutual Recognition Agreements on Conformity Assessment equivalent to those negotiated between the Community and those countries; the EEA Council welcomed the readiness of the EEA/EFTA States to begin parallel negotiations with those countries in Central and Eastern Europe with which the Community intends to conclude European Conformity Assessment Agreements and set up special administrative structures; while referring to the importance of the Commission's Action Plan for the Single Market underlined its general relevance to the EEA Agreement and appreciated the joint intention to cooperate on relevant projects resulting from the Action Plan; welcomed that in a spirit of constructive cooperation a solution to the salmon issue has been found in consultations between the Commission and Norway ; 5. The EEA Council noted the importance of the proposed European Parliament and Council directive on common rules for the internal market in natural gas for the supply and utilization of natural gas within the EEA.

Voor de sluiting van de Overeenkomst geldt het volgende: - de Raad sluit de overeenkomsten namens de Europese Gemeenschap, met de instemming van het Europees Parlement; - de Commissie sluit de overeenkomsten, nadat deze door de Raad zijn goedgekeurd, namens de Europese Gemeenschap voor Atoomenergie, - de Commissie sluit de overeenkomsten namens de EGKS, overeenkomstig artikel 95 van het EGKS-Verdrag, na raadpleging van het Raadgevend Comité en met de eenparige instemming van de Raad; De overeenkomsten dienen voorts door alle Lid-Staten te worden geratificeerd, gezien het gemengde karakter van de Overeenkomst.
For the purpose of concluding the Agreements: - the Council will conclude the Agreements on behalf of the European Community, with the assent of the European Parliament; - the Commission will conclude the Agreements on behalf of the European Atomic Energy Community after approval by the Council; - the Commission will conclude the Agreements on behalf of the ECSC in accordance with article 95 of the ECSC Treaty, after consulting the Consultative Committee and with the unanimous assent of the Council. The conclusion of the Agreements will have to be ratified by all the Member States given the mixed nature of the Agreements.
