Is seriously concerned about the recent allegations of corruption within EULEX; believes that EULEX has played, and still should and could play, an important role in Kosovo, and thus welcomes the prompt reaction of VP/HR Federica Mogherini in appointing an independent expert to probe into the handling of such allegations in depth; calls for full transparency in this investigation and urges all those concerned to cooperate fully so that the investigation can be swiftly concluded; stresses the importance of ensuring that the expert can pursue a comprehensive investigation covering all aspects of the case; is concerned at the fact that sensitive documents on the corruption allegations within EULEX have gone missing; calls for a thorough and comprehensive investigation; stresses that it is of utmost importance to restore the credibility of the EU in Kosovo and abroad and to consider the lessons learned for future missions; notes that both the Ombudsperson and OLAF decided to start independent investigations on the alleged EULEX misconduct and calls on all investigators to effectively coordinate their actions and exchange information; considers, however, that a broad and deep analysis is needed, in order to assess the overall effectiveness of EULEX and the adequacy of its performance, updating the report published in October 2012 by the European Court of Auditors;

Underlines the importance of the independent, rapid and full investigation, delegated to the Dutch Safety Board, into the causes of the downing of Malaysia Airlines flight MH17, and the need to bring those responsible for the crash to justice; notes that the Dutch Safety Board issued its preliminary report on the investigation into the crash of MH17 on 9 September 2014; stresses that, based on the preliminary findings to date, no indications of any technical or operational issues were found with the aircraft or crew, and that the damage observed in the forward section appears to indicate that the aircraft was penetrated by a large number of high-energy objects from outside the aircraft; deplores the fact that the rebels are still not permitting unhindered access by investigators to the crash site, and calls on all sides to facilitate immediate access;

In de punten 216 tot en met 218 van het rapport van de WTO-Beroepsinstantie wordt bepaald dat ingevolge artikel 5.8 van de WTO ADO een onderzoekende instantie het onderzoek ten aanzien van een exporteur waarvan in een oorspronkelijk onderzoek werd vastgesteld dat zijn marge niet meer dan de minimis is, moet beëindigen en in alinea 305 van dat rapport dat deze exporteur bijgevolg van de definitieve antidumpingmaatregelen moet worden uitgesloten en ook niet betrokken kan worden bij een nieuw onderzoek om administratieve redenen dan wel in verband met gewijzigde omstandigheden.
The WTO Appellate Body report provides in paragraphs 216 to 218 that Article 5.8 of the WTO ADA requires an investigative authority to terminate the investigation in respect of an exporter found not to have a margin above de minimis in an original investigation and, in paragraph 305, that the exporter consequently must be excluded from definitive anti-dumping measures and cannot be subject to administrative and changed circumstances reviews.

In the notice of initiation, the Commission also announced the initiation of a review pursuant to Article 2(3) of Regulation (EC) No 1515/2001 (‘review pursuant to Regulation (EC) No 1515/2001’) in order to allow for any necessary amendment of Regulation (EC) No 452/2007 in the light of the WTO Appellate Body report entitled ‘Mexico — Definitive Anti-dumping Measures on Beef and Rice’ (AB-2005-6) (5) (the ‘WTO Appellate Body report’).

Notes that the new Secretary-General initiated an administrative inquiry following the results of an OLAF investigation, although its results were not communicated to the Committee on Budgetary Control in time for the 2002 discharge; ".in his report the Secretary-General concluded that the enquiry had identified individual failings and lack of professionalism as well as .administrative weaknesses. However ., none of these individual failings could be regarded .as serious enough to justify the opening of disciplinary procedures against any of the officials concerned" ; takes note that none of the officials who were the subject of the administrative inquiry has been promoted since the completion of the report;

The investigator must acquaint himself with the conclusions drawn from the pharmacological and toxicological studies and hence the applicant must provide him at least with the investigator's brochure, consisting of all the relevant information known prior to the onset of a clinical trial including chemical, pharmaceutical and biological data, toxicological, pharmacokinetic and pharmacodynamic data in animals and the results of earlier clinical trials, with adequate data to justify the nature, scale and duration of the proposed trial; the complete pharmacological and toxicological reports shall be provided on request.
