TRADUCTIONS EN CONTEXTE

Binnen de beperkingen van hun respectieve bevoegdheden komen de partijen overeen dat voor de toepassing van de overeenkomst intellectuele, industriële en commerciële eigendom inzonderheid het volgende omvat: auteursrechten, met inbegrip van de auteursrechten op computerprogramma’s, en naburige rechten, de rechten voor octrooien, industriële ontwerpen, geografische aanduidingen, met inbegrip van benamingen van oorsprong, warenmerken en dienstmerken, topografieën van geïntegreerde schakelingen, alsmede bescherming tegen oneerlijke mededinging als bedoeld in artikel 10 bis van het Verdrag van Parijs voor de bescherming van industriële eigendom en bescherming van niet-openbaargemaakte informatie over knowhow.
Within the limits of their respective competences, the Parties agree that for the purpose of this Agreement, intellectual, industrial and commercial property includes in particular copyright, including the copyright in computer programs, and neighbouring rights, the rights relating to patents, industrial designs, geographical indications, including appellations of origin, trademarks and service marks, topographies of integrated circuits as well as protection against unfair competition as referred to in Article 10bis of the Paris Convention for the protection of Industrial Property and protection of undisclosed information on know-how.

2. Elke partij verzekert dat haar behandeling van de rechten en verplichtingen inzake intellectuele eigendom van deelnemers aan indirecte samenwerkingsactiviteiten en de gerelateerde rechten en verplichtingen die uit deze deelname voortkomen verenigbaar zijn met de relevante wet- en regelgeving en internationale verdragen, inclusief de Overeenkomst inzake de handelsaspecten van het intellectuele eigendom, bijlage 1C van de Overeenkomst van Marrakesh tot oprichting van de Wereldhandelsorganisatie alsmede de Akte van Parijs van 24 juli 1971 van de Berner Conventie voor de bescherming van werken van letterkunde en kunst en de Akte van Stockholm van 14 juli 1967 van het Verdrag van Parijs tot bescherming van het industriële eigendom.
2. Each Party shall ensure that its treatment of the intellectual property rights and obligations of participants in indirect cooperative activities, and the related rights and obligations arising from such participation, shall be consistent with the relevant laws and regulations and international conventions, including the Agreement on trade-related aspects of intellectual property rights, Annex 1C of the Marrakech Agreement establishing the World Trade Organisation as well as the Paris Act of 24 July 1971 of the Berne Convention for the protection of literary and artistic works and the Stockholm Act of 14 July 1967 of the Paris Convention for the protection of industrial property.

Under the Agreement, the Parties agree that intellectual, industrial and commercial property comprises, in particular, copyright, including copyright in computer programs, and neighbouring rights, database rights, commercial trademarks and geographical descriptions including designation of origin, industrial designs and models, patents, configuration plans (topographies) of integrated circuits, protection of undisclosed information and protection against unfair competition in accordance with Article 10(a) of the Paris Convention for the Protection of Industrial Property (1967 Stockholm Act) and the protection of confidential information concerning ‘know-how’.

Draws attention to the fact that the Union should enter the new WTO negotiations on the basis of an independent position; considers, however, that common EU/US approaches should be sought, involving in particular specific dialogue on dispute settlement, general standstill, implementation of WTO agreements, services, agriculture, trade facilitation, industrial tariffs, technical barriers to trade, intellectual property, investment, competition, government procurement, trade and environment, accession to the WTO, developing countries, electronic commerce, core labour standards;
