De werking van het stelsel voor de controle van de traditionele eigen middelen wordt om de drie jaar behandeld in een verslag aan het Europees Parlement en de Raad[1]. De rechtsgrond voor het stelsel voor de controle van de traditionele eigen middelen wordt gevormd door Besluit 2000/597/EG, Euratom van de Raad van 29 september 2000[2], Verordening (EG, Euratom) nr. 1150/2000 van de Raad van 22 mei 2000[3] en Verordening (EG, Euratom) nr. 1026/1999 van de Raad van 10 mei 1999[4]. Dit verslag is het vijfde verslag van dit type[5] en en beschrijft en analyseert de werking van het stelsel voor de controle van de traditionele eigen middelen voor de periode 2003-2005.
Every three years the Commission compiles a report for the European Parliament and the Council on the operation of the inspection system for traditional own resources.[1] The inspection of traditional own resources is based on Council Decision 2000/597/EC, Euratom of 29 September 2000,[2] Council Regulation No 1150/2000 of 22 May 2000[3] and Council Regulation No 1026/1999 of 10 May 1999.[4] This report, the fifth of this type,[5] describes and analyses the operation of the inspection system for traditional own resources for the period covering 2003 to 2005.

The annex to this report describes the objectives of the inspections and how the inspection system operates at Community level.

Net als in de vorige verslagen bevestigen de onregelmatigheden in de werking van het stelsel voor de controle van de traditionele eigen middelen die in de periode 2003-2005 zijn vastgesteld, dat de Commissie zeer veel belang heeft bij haar controles.
As in previous years, the anomalies noted in the operation of the inspection arrangements for traditional own resources during the period 2003-2005 confirm the benefit which the Commission can derive from the inspections it carries out.

Om ervoor te zorgen dat het nieuwe, bij die verordening vastgestelde rechtskader soepel functioneert en op uniforme wijze wordt toegepast, is aan de Commissie de bevoegdheid verleend om bepaalde voorschriften vast te stellen voor administratieve controles en controles ter plaatse, de meting van arealen, de gevallen waarin steunaanvragen en betalingsaanvragen kunnen worden gecorrigeerd, de toepassing en berekening van een gedeeltelijke of volledige intrekking en de terugvordering van onverschuldigde betalingen en sancties, de toepassing en berekening van administratieve sancties, eisen met betrekking tot het geautomatiseerde gegevensbestand, steunaanvragen en betalingsaanvragen en aanvragen voor betalingsrechten, waaronder de uiterste datum voor de indiening van die aanvragen, de uitvoering van controles, de overdracht van bedrijven, betalingen van voorschotten, de uitvoering van controles in het kader van de randvoorwaarden, de berekening en toepassing van administratieve sancties bij niet-naleving van de randvoorwaarden, en technische specificaties die nodig zijn voor een uniforme toepassing van de basisvoorschriften inzake het geïntegreerd beheers- en controlesysteem („geïntegreerd systeem”) wat de randvoorwaarden betreft.
In order to ensure that the new legal framework established by that Regulation functions smoothly and applies uniformly, the Commission has been empowered to adopt certain rules in relation to administrative and on-the-spot checks, the measurement of areas, the cases in which aid applications or payment claims may be corrected, the application and calculation of partial or total withdrawals and the recovery of undue payments and penalties, the application and calculation of administrative penalties, the requirements for the computerised database, aid applications and payment claims and applications for payment entitlements, including the final date for submission, the carrying-out of checks, transfers of holdings, payments of advances, the carrying-out of checks relating to cross-compliance obligations, the calculation and application of administrative penalties in cross-compliance and technical specifications necessary for the purpose of the uniform application of the basic rules on the integrated administration and control system (‘integrated system’) as regards cross-compliance.
