Recalls the obligation to guarantee access to justice and information in environmental matters, and public participation in decision-making, as laid down in the Aarhus Convention; calls, therefore, on the Commission, the Member States and their regional and local authorities to respect the principles and rights enshrined in the Aarhus Convention; recalls that citizens’ awareness of their rights is fundamental to achieving the widest possible participation in the decision-making process; urges the Commission, therefore, to proactively set up a campaign to inform EU citizens about the achievements of the Aarhus Convention in the field of transparency and about the effective tools already at their disposal, and to comply with the provisions referring to the EU institutions; calls on the Commission to develop transparency, accountability and participation criteria as a means to improving the performance, sustainability and cost‑effectiveness of water services;

The correct and coordinated implementation of Directive 2011/92/EU of the European Parliament and of the Council of 13 December 2011 on the assessment of the effects of certain public and private projects on the environment (15), of Directive 2001/42/EC of the European Parliament and of the Council of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment (16), where applicable, of the Convention on access to information, public participation in decision-making and access to justice in environmental matters, signed in Aarhus on 25 June 1998 (17) (the ‘Aarhus Convention’), and of the Espoo Convention on environmental impact assessment in a transboundary context (the ‘Espoo Convention’) should ensure the harmonisation of the main principles for the assessment of environmental effects, including in a cross-border context.

On 25 June 1998 the Community signed the United Nations Economic Commission for Europe (UNECE) Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters (hereinafter the Aarhus Convention).

Furthermore, the requirement to comply with the provisions of the Århus Convention also extends to Community institutions and bodies. That is why the present regulation seeks to ensure full respect for the principles laid down in the Convention by the Community’s institutions and bodies and to bring the three pillars of the Convention together in a single legislative act.
