27. Calls on the Commission, in its next report on the application of the AVMSD, to assess whether the Member States have implemented this directive in a way that preserves the necessary and existing balance between, on the one hand, safeguarding the principle of freedom of access to information, especially on events of high interest to society, and, on the other hand, the protection of rights holders;

5a. Each year, the Commission shall present to the European Parliament, the Council and the European Economic and Social Committee a report on the application of this Framework Decision, paying special attention to the application of procedural safeguards.

The first report on the application of Directive 2000/43/EC raised concerns that ‘the scarcity of ethnic data in most Member States might hinder proper monitoring of the application of Community legislation’.
