TRADUCTIONS EN CONTEXTE

In geval van een verplaatsing van de statutaire zetel van een SE of SCE moeten de EU-landen de nodige maatregelen nemen om ervoor te zorgen dat voorzieningen of reserves die de SE of de SCE volgens de voorschriften heeft aangelegd vóór de verplaatsing van de statutaire zetel, en die geheel of gedeeltelijk belastingvrij zijn en niet uit vaste inrichtingen in het buitenland voortkomen, met dezelfde belastingvrijstelling kunnen worden overgenomen door een vaste inrichting van een SE of SCE die is gevestigd op het grondgebied van het EU-land van waar de statutaire zetel werd verplaatst.
In the same case, EU countries shall take the necessary measures to ensure that, where provisions or reserves properly constituted by the SE or the SCE before the transfer of the registered office are partly or wholly exempt from tax and are not derived from permanent establishments abroad, such provisions or reserves may be carried over, with the same tax exemption, by a permanent establishment of the SE or the SCE which is situated within the territory of the EU country from which the registered office was transferred.

B. overwegende dat de lidstaten dat hebben gedaan in Protocol nr. 6 bij de Verdragen, waarbij Brussel is aangewezen als zetel van de Commissie, de Raad – met dien verstande dat de zittingen in de maanden april, juni en oktober in Luxemburg worden gehouden –, het Economisch en Sociaal Comité en het Comité van de Regio's, Luxemburg als zetel van het Hof van Justitie van de Europese Unie, de Rekenkamer en de Europese Investeringsbank, Frankfurt als zetel van de Europese Centrale Bank en Den Haag als zetel van de Europese Politiedienst;
B. whereas the Member States have done so in Protocol 6 annexed to the Treaties, establishing Brussels as seat of the Commission, the Council (with its meetings to be held in Luxembourg during the months of April, June and October), the Economic and Social Committee and the Committee of the Regions, establishing Luxembourg as seat of the Court of Justice of the European Union, the Court of Auditors and the European Investment Bank, establishing Frankfurt as seat of the European Central Bank and establishing The Hague as seat of the European Police Office;

H. overwegende dat het Hof van Justitie heeft verklaard dat de plaats van de zetels geen belemmering mag vormen voor de goede werking van het Parlement; overwegende dat het Hof voorts heeft verklaard dat er weliswaar nadelen en kosten verbonden zijn aan het in stand houden van verschillende werklocaties, maar dat een wijziging van de zetel of de werklocaties slechts mogelijk is als de Verdragen worden gewijzigd, waarvoor de lidstaten hun goedkeuring moeten geven;
H. whereas the ECJ has stated that the location of the seat is not to hinder the well-functioning of Parliament; whereas it has further stated that while there are disadvantages and costs engendered by the plurality of working locations, any modification of the seat or working locations would require a Treaty change and, thus, the consent of the Member States;

1. Voor de resterende duur van de zittingsperiode 2009-2014 vanaf de datum van inwerkingtreding van dit artikel, en in afwijking van de artikelen 189, tweede alinea, en 190, lid 2, van het Verdrag tot oprichting van de Europese Gemeenschap en van de artikelen 107, tweede alinea, en 108, lid 2, van het Verdrag tot oprichting van de Europese Gemeenschap voor Atoomenergie, die van kracht waren ten tijde van de verkiezingen voor het Europees Parlement van juni 2009, en in afwijking van het aantal zetels waarin is voorzien in artikel 14, lid 2, eerste alinea, van het Verdrag betreffende de Europese Unie, worden de volgende 18 zetels toegevoegd aan de huidige 736 zetels, waardoor het totaal aantal leden van het Europees Parlement tijdelijk op 754 wordt gebracht tot het einde van de zittingsperiode 2009-2014:

For the period of the 2009-2014 parliamentary term remaining at the date of entry into force of this Article, and by way of derogation from Articles 189, second paragraph, and 190(2) of the Treaty establishing the European Community and Articles 107, second paragraph, and 108(2) of the Treaty establishing the European Atomic Energy Community, which were in force at the time of the European Parliament elections in June 2009, and by way of derogation from the number of seats provided for in the first subparagraph of Article 14(2) of the Treaty on European Union, the following 18 seats shall be added to the existing 736 seats, thus provisionally bringing the total number of members of the European Parliament to 754 until the end of the 2009-2014 parliamentary term:

The necessary arrangements concerning the accommodation to be provided for Europol in the headquarters State and the facilities to be made available by that State as well as the particular rules applicable in the Europol headquarters State to the Director, the members of the Management Board, the Deputy Directors, employees of Europol and members of their families shall be laid down in a Headquarters Agreement between Europol and the Kingdom of the Netherlands to be concluded once the approval of the Management Board has been obtained.

The allocation of seats by Member State proposed by the European Parliament was based on the following formula: 6 seats to be allocated to each Member State regardless of population, plus an additional seat per 500,000 inhabitants for the number of inhabitants between 1 and 25 million, an additional seat per million inhabitants for the number of inhabitants between 25 and 60 million, and an additional seat for every two million inhabitants above 60 million.
